(Wherever used herein the terms "Grantor" and "Grantee" include all the parties to this instrument and their respective heirs, legal representatives, successors or assigns.) WIT N E SSE T H: Grantor, for and in consideration of TEN DOLLARS ($10.00) and other valuable consideration paid by the Grantee, the receipt and sufficiency of which is hereby acknowledged, hereby conveys, grants, bargains and sells unto the Grantee, its successors and assigns, a perpetual, non-exclusive easement for all irrigation quality water utility facilities and access purposes, over, under, upon, and across the following described lands located in Collier County, Florida, to wit: See attached Exhibit "A" which is incorporated herein by reference. Subject to easements, restrictions, and reservations of record. THIS IS NOT HOMESTEAD PROPERTY. TO HAVE AND TO HOLD the same unto the Grantee together with the right to enter upon said land, excavate, and place or remove materials, including, but not limited to irrigation quality water lines and pipes, electrical panels, telemetry tower, and other equipment or improvements appurtenant thereto or thereunder for the purpose of constructing, operating, and maintaining irrigation quality water utility facilities thereon. PROJECT: 10 Water Telemetry Remote SitesNeterans Park P~OJECT No.: 70433 FbLlO No.: 00166840007 By execution of this instrument, Grantor agrees that any and all pipeline infrastructure constructed on the property hereinabove referenced, with the exception of the water meter assembly and any pipelines connecting said assembly with Grantee's water distribution mains, shall become the property of the Grantor, and all future maintenance and repair will be the responsibility of Grantor. Following construction, Grantee's responsibility for maintenance shall be limited to Grantor's SCADA control panel, telemetry antenna, and pipeline facilities extending upstream from the 4 inch gate valve immediately downstream of Grantee's water meter assembly, and shall not extend to the Grantor's booster pump, control panel, and irrigation distribution pipelines and facilities.
