Dear Mr. Maii'alich;
I am looking forward to being an active participant of the Hispanic Affairs Advisory
Board. I appreciated the Board's recommendation and hope to be appointed by the
Commission. I was able to attend the Affordable Housing Workshop at the Commission
meeting today, and I have notes to share with HAAB members.
I am not sure if! will be appointed by the time of the next meeting, but I am afraid I will
not be able to be there in any case. As I believe I indicated at the last meeting, I have a
commitment to be out of town that week. We have family obligations out of state. Ifthere
is any chance I can return earlier, I will. The focus of the next meeting is of great interest
tome.
Please convey my regrets to the members of the HAAB on this matter.

The April 26, 2001 meeting of the Collier County Hispanic Affairs Advisory Board
(HAAB) took place at the Golden Gate Community Center and began at approximately
7:12 P.M. A quorum of six (6) members was present.
A motion was made by Elvin Santiago to approve the minutes of the March 22, 2001
meeting and the motion was seconded by Frank Loney. A unanimous vote of 6 to 0
occurred in favor of approving the minutes with corrections to the names of Mr. Pina and
Ms. Cisneros where mentioned in the minutes. The other correction in the minutes was
to note that ElvinSantiago was absent at the March meeting,
There was a discussion regarding Mr. Santiago's absence in March. A motion was made
by Prank Loney to consider the absence an excused absence and the motion was
seconded by David Correa. There was a 6 to 0 vote in favor of the motion. The excusal
of Mr. Santiago's absence was based on a misunderstanding as to whether the meetings
were to be held on the last or the fourth Thursday of each month. It was also clarified at
this time that the intent was to have the meeting on the fourth Thursday of each month.
Interview of Applicants for
Membership on the Hispanic Affairs Advisorv Board
The Hispanic Board proceeded to interview applicants for membership on the HAAB.
The first was Yolanda Cisneros. Chairman Correa introduced her. She stated that she
lives in Immokalee and is involved in organizations and in the community. Yolanda
indicated that she wants to be an active participant in the HAAB. She commented that
she had seen the HAAB do positi ve things. She has been a patient advocate of East Point
Hospital. That job will not conflict with her services on the Board. Mr. Victor Valdes,
Editor, Las Naciones News stated that he had known Yolanda for some time and that she
works hard for Hispanics and for the community and recommended her for appointment
to the board. A motion was made by Prank Loney to recommend Yolanda for the longer
HAAB term now available. Elvin Santiago seconded the motion and a vote of 6 to 0 in
favor of the motion occurred.
Susan Calkins was the next interviewee. She explained that she has taught sociology and
anthropology. Cultural and social diversity are part of those subjects of study. She stated
that she is not Hispanic but that she has skills and perspecti ves which will be valuable to
the Hispanic community. She wants the Hispanic community to be heard by the county
and for the county to respond. She believes that there are issues of minorities and the
institutions. She mentioned that she has previously organized forums in the community.
She values multi-ethnic communities as a year-around resident. She speaks a small
amount of Spanish. A brief discussion was held by the members regarding the role of the
HAAB and prior activities of the HAAB. A motion was made by Elvin Santiago,
seconded by Robert Pina, to recommend Ms. Calkins for an appointment. The vote was 6
to 0 in favor of the motion.
Staff liaison, Ramiro Mafialich reminded the Board members of the attendance
requirements in the HAAB ordinance. He explained that member Leo Cardona has had
many absences due to schedule conflicts. David Correa commented that he believed that
medical studies were interfering with Leo's attendance. David Correa stated that Leo
Cardona is a good person, but that he must be replaced under the terms of the ordinance,
as his presence is needed at the meetings. Elvin Santiago made a motion to declare a
vacancy, which was seconded by Frank Loney. The vote was 6 to 0 to approve the
motion.
Cinco De Mavo Discussion
The members discussed whether or not the HAAB should have a formal presence at the
Cinco De Mayo celebration in Immokalee. Frank Loney mentioned that perhaps Las
Naciones News could carry information about the HAAB to those in the community who
will be interested in the celebration. However, he commented that he thought it was too
late this year for the HAAB to attempt to organize a meeting at the festival. Yolanda
Cisneros mentioned that there is a fee to set up a booth at the festival. Some HAAB
members said that they might be able to attend the event individually. It was thought that

next year would be a better time to have a formal organized HAAB presence at the
festival. Prank Loney thought that it would be appropriate to begin in January to
organize for the May event. Yolanda Cisneros indicated that she would explore
organizational efforts on behalf of the HAAB for next year.
Farm Worker Issues
HAAB members discussed past failed efforts to convince the Board of County
Commissioners to become involved in the farm worker issues. Staff Liaison Ramiro
Mafialich informed the Board members that Parm Worker Representative Lucas Benitez
had indicated the continuing interest of his organization for having the assistance of the
HAAB and of the Board of County Commissioners regarding the farm worker issues.
Prank Loney thought that that the HAAB should send correspondence in support of the
farm worker to the Board of County Commissioners. He also suggested that there be a
meeting in Immokalee about this subject. It was decided by the HAAB members that on
Wednesday, May 23, 2001, at 7:00 p.m. at the Immokalee Community Park that a
meeting would be held to discuss farm worker issues.
Elvin Santiago commented that he is aware that the growers face pressures from the
Economic Pree Trade Treaties which have recently been passed and the low overseas
wages and lack of environmental controls which allow foreign countries to produce fruits
and vegetables at lower prices. He also thought that there were some isolated situations
where Hispanics are taking advantage of other Hispanics in this industry. Prank Loney
commented that he had observed many inhumane conditions in the general community of
Immokalee and in this particular industry. Robert Pina questioned why there are not
strict housing standard regulations in Immokalee because such regulations exist in other
states.
Census/Elections
A brief discussion was held by the Board members regarding the recent census data as it
relates to Hispanics and the voting patterns for Hispanics in Collier County. Elvin
Santiago mentioned that it is obvious that there is too small of a percentage of minority
voting in the County. David Correa stated that there was a need to educate and get
Hispanics to vote and participate in the political process. Prank Loney suggested using
the churches to get voter registration efforts in place. However. he observed that such
efforts have had very little success in the past. He mentioned that perhaps the availability
of voter registration information at grocery stores would be of assistance. He also
suggested that all minorities should work together on the voter registration efforts and not
just concentrate on individual nationalities.
The Board asked Liaison Ramiro Mafialich to invite the Elections Supervisor to discuss
this topic at a future meeting.
Robert Pina reminded the members that there is an affordable housing workshop at the
Board of County Commissioners meeting room on May 15.

Valdes/Sheriff Issues
David Correa asked the members if there were additional concerns regarding the previous
months discussions and presentations by Mr. Valdes and the Collier County Sheriff. On
lhis point, Mr. Valdes commented that he has many issues still pending with the Sheriff.
He referenced the letter from the Governor's Office to the Florida Department of Law
Enforcement regarding investigation of the Collier County Sheriff's Office. He says that
the investigation was flawed because the investigator did not want to review exhibits or
the entire list of witnesses that Mr. Valdes provided. In fact, Mr. Valdes claims that 90%
of the witnesses were not interviewed. He says that the investigator only looked at issues
regarding Deputy Edison and not the broader corruption and misconduct allegations
which Mr. Valdes has raised in the past. Mr. Valdes commented that, in 1989, he
presented allegations to the sheriff and offered proof. He says that Attorney Melinda
Riddle and other community business people also approached the sheriff. Mr. Valdes
mentioned that his upcoming forum would layout evidence previously presented to the
sheriff. Mr. Valdes stated that he also has a lawsuit against the sheriff because of 12
arrests and 11 no action results stemming from those arrests against him. Mr. Valdes
briefly mentioned the Federal Court trial which he has pending and a video which had
been used to prosecute him. Mr. Valdes stated that he would defend himself against the
video and perjury charge which are pending against him. He said that his civil case is
currently on hold. He says that the tape which is the subject of the perjury charge was
suspiciously in the custody of the police officer at the officer's home for a period of five
years. He says the tape was not produced in discovery. Mr. Valdes concluded by
inviting the HAAB to attend his upcoming forum regarding civil rights violations in
Collier County, He also requested that the HAAB review the information and proof
which he has produced in the past and has summarized in his Las Naciones Newspaper.
The bottom line, according to Mr. Valdes, is that the sheriff knew that the Edison
corruption was going on and that the sheriff did nothing. Instead, Mr. Valdes claims that
the sheriff's office harassed him.
Commissioner Coletta Correspondence
Liaison Ramiro Mafialich made the members aware of correspondence received from
Collier County Commissioner Jim Coletta about the Hispanic Board. A copy of said
letter is attached. In regard to Mr. Coletta's letter, member Pina clarified that his
comments in the previous minutes referred to by Mr. Coletta's letter merely had to do
with affordable housing. His point was since there was no funding from the county there
were also no federal dollars being received.
The HAAB requested Liaison Ramiro Maiialich to thank Commissioner Coletta for his
interest in attending a future HAAB meeting and to coordinate for that to occur.
The meeting of the HAAB adjourned at approximately 9:05 p.m.

In your meeting minutes ofPebruary 22,2001, Mr. Pena mentioned, "The CCBC doesn't seem to
want to support social services". I don't believe this is the case at all. The present make up of
the Commission is very positive to the need of social services.

WHEREAS, agricultural workers in the great state of Florida continue to suffer truly sub-standard
and shameful worldng and living conditions; and
WHEREAS, the growers of our stare continue to flatly reject all efforts toward cooperation and
dialogue on the part of agricultural WOIkers to improve those UDB.cceptablc conditions; and
WHEREAs, Governor Jeb Bush bas declared in his yearly Proc)ltmlttion of "Florida Farm Workcr
Week" that we as a state must look "towards a future of continued cooperation between agriculturaI
employers, both large and small, and fium workers.";
THEREFoRE, we. as a united community of agricultural workexs across Florida, ask. of Govcmor
Bush that he use his political and morallcadership to help resolve the problems oflabor relations,
wages. and other working conditions in the fields of our state.
SpecificaUy. we ask. that Governor Bush organize and facililate a series of four regional taJks, or
"summits", on the issues of labor relations, wages, and other working conditions, to be held
between growers active in the state's fruit and vegetable induslIy and representatives of farm worker
orgAni'7Jltin'1s.
We ask that these talks be held in the fOllowing towns: Dade City,lmmokalee, Apoplra, and
Quincy, and that they be completed before 18XlW1Iy 1, 2001.
The Governor or a represen1ative oIhis administration would serve as tacilitator and D1..n;At.or of.the
talks. The Governor inust participate personally in at least one of the four talks.
As a result of this series of talks, the Governor would produce a report with his reeommendatioDS
for a pl'Setical meclumiBm for fair and appropriate resolu1ioD of labor conflicts in agriculture
in the future. The report ~ust be made public before April 1, 2001.
The Govel1lOr would make all good-faith efforts to encourage the growers to participate, but in the
event that they do not agree to do so, the Governor (and/or his representative) must hold three
meetings with farm warlc.er representatives and complete his report on an appropriate labor con:flict
resolution ml'<'h"n;OTTl before January 31, 2001.

with representatives of your company to discllSs a problem we are fac:ing here in the fields of Florida.

We are aware that your company has recently developed a long-term "partnership" with the Six L's
Packing Co. Inc., one of the major employers in our area, for the year-round supply of tomatoes. We _
the men and women who plaut, cultivate, and pick those tomatoes - have also been trying to establish a
better, more productive relationship with Six L's for the p:u.'t several years. Ust year, huudreds of Six L's
worleers signed a petition seeking talks with the directors of the company on the issue of the picking piece
rate (we are paid 40-45 cents for every 32-pound bucket of tomatoes that we pick). The piece rate has been
effec:t!vely stagnant for over twenty years. To date, however, Six L's has.refused to meet with us, and that
is why we are writing to yon.
We believe that we, too, are partners in this industry, and that by virtue of our hard worle we have earned the
right to talk with our employers about our wages and the conditions of our work. Two years ago, two
thousand fannworkers in Immok:alee signed c:ards supporting the OW's call for dialogue with ten of the
area's largest tomato growers. When that petition was ignored by nine of the growen, six of our members
went on a hunger strike. Their fast laated for one month, and only ended when fonner President Jimmy
Carter intervened (as the late Governor Lawton Chiles had before him). asking for talks. The growers !>-till
refused. Again this season, farmworkenl throughout lrnmokaIee signed a .petition asking for dialogue.
Once again the growers (including Six Vs) refused, leading to a communtty-wide protest and work
StOppage for a week this past December. Since that time we have met with US Senator Bob Gr.mam and
representatives of Governor Jeb BlISh about our situation, but the growers still refuse to meet.
We would like to talk with representatives of your company to discuss the conditions that we face picking
tomatoes for Sill; L's and other compenies in our area, and to share our ideas as to how Taco Bell could
help bring about much-needed change for the workers who pick your tomatoes. We have included hen: a
few articles about our situation, so that you might have a fuller idea of the problelDll that we continue to fac:e
today, nearly 40 years after the famous CBS documentary "Harvest of Shame". We truly believe that
Taco Bell is a responsible cOlpOI'lIte neighbor and that your company understands that conditions like those

We are writing to you today from the Coalition of Immokalee Worltcrs (CIW). One year ago, we sent our
first letter to Taco Bell, addressed to the Cbief Operating Officer at that time, Mr. Thomas Davin (see copy
enclosed). As we mentioned in that letter, the CIW is a community organization offarmworkers based in
Tmmor..1ee, Florida Our members ~ick the tomatoes that restaurants like Taco Bell buy from the many
fresh tomato producen that operate In OUl' area.
In ourfint letter. we requested a meeting with Mr. Davin about some very serious problems we are facing
here in the fields of Florida. Later last year, we again communicated with Taco Bell personnel, this time by
phone, about a possible meeting with the new CEO, Mr. Peter Waller. To this date, Taco Bell
represeDtatives have chosen not to meet to discuss our aituatiOIl. Despite your predecessors' reluctance to
hear our members' concerns, we write today in the hope that you may look upon this issue with a new
perspc:ctive. And so. in the spirit of COOpel3ti.on, we are again writing to request a mec:ting to discuss what
we feel are our mutual interests in the development of a more humane, more modem tomato industry.
In our earlier letter we ell.plained in detail the problems that fannworkers face in the tomato harvest. and in
particular the problems affecting workers who pick for Six L's, one of Taco Bell's principal partners for
the year-round supply oftcmatoes. Sub-poverty wages, stagnant piece: rates, no right to overtime pay, no
health insurance. no sick leave, no holiday leave, and no pension are just some of the conditions that
farmworkers face in Six L'a' fields. Unfortunately, these conditions are not limited tn Silt L's but are
found throughout the tomato industry. Six L'a docs. however. stand out as one of the lowest paying
companies in the indlUlry. At 40 cents per 32-pound bucket picked., Six L's pays today what the indusuy
paid as a standard piece rate over 20 vears ase. [See accompanying document on piece rates since 1980.1
We believe that Taco Bell has the power to dramatically change the lives of the men and women who plant,
cultivate, and harvest the tomatoes that add so much value to Taco Bell's products. As a major buyer of
fresh lPn1S1t""", Taco Bell occupies a position of great influence over - and mlponsibility for - the
working conditions facing tomato pickers here in Florida.
For several years now, major brand name companies in the apparel industry have been held accountable by
consumers for the conditions found in their subcontractors' factories, Dr "sweauhops", as they are
popularly known. As a result, many of those companies have used their influence to significantly improve
those conditions. In this same way, we believe that Taco Bell, all a responsible corporate citizen and a major
brand name in the food industzy. can help bring much-needed change to our situation.
As a concrete example, if Taco Bell were to pay just one pennv more per pound for the 1DmatDeS it buys
from Florida growers, and the growers were to pass that ell.tra penny on to the workers, the picking piece
rate paid to workers could near1v double. While, clearly. such a change would represent an additional cost

There is no doubt that the young people who like to eat at Taco Bell are sCJlS.itive to the working conditions
of those that produce the things they consume. In the same way that they have led the charge to reform
swears.bop conditions in the apparel industly, high school and collegc-age consumers have, conversely,

IMMOKALEE. Fla. - Around here, complacency
might as well be the plague.
Like the Florida tomato industry in microcosm,
Immokalee is a shell of its former self. The locals can
point here. there and everywhere - and teU you a
story 0[. another tomato or vegetable shipper that
wen t belly up years ago. .
For the most part, like the industry at large, the few
. who've endured also have thrived. Six L's Packing Co,
Inc. certainly has. Its sprawling facilities. some of
them new or recently renoV<lted, reveal a company eg-
gressivelY.preparing for growth opportunities iil the'
new millennium.
The approach of Six Vs could be called noncon.

nationwide boycott of the Taco Bell MeXican fast food
chain as part of a campaign to improve the living
conditions of immigrant tomato pic:kers.
They are planning to demonstrate outside a Taco Bell

(CIW). He admits as farmworkers they do not have

I'm updating my books now, and I just wanted to be sure I don't make false assumptions - HAAB will not hold
their regular meetings at GGCC (unless I receive future requests from you or a new contact person in writing)
starting immediately, correct? In other words, even though our situation will not occur until the fall, they
have made other arrangements effective immediately. We had already cancelled May, since they will be
meeting in Immokalee. But I will now also be taking them out of the book from June on. Please confirm.

While convened in regular session on May 22, 200 I, the Board of County Commissioners voted
to appoint you as a regular member on the above-referenced advisory committee. Your
appointment will expire on June 25, 2005, or at such time as the Board re-appoints you or
appoints your successor.
As with any advisory group, the primary purpose is to assist and advise the Board of County
Commissioners. By law, however, the ultimate decisions rest with the Commission. At times,

The Board received a request to remove you from the Hispanic Affairs Advisory Board due to
