Ordinance 77-39ORDINANCE 77-39 kN ORDINANCE PROVIDING FOR THE ESTABLISHMENT OF THE MARCO ISLAND FIRE CONTROL MUNICIPAL SERVICES TAXING DISTRICT; DESIGNATING THE BOUNDARIES OF T}{E DISTRICT; AUTHORIZING A TAX LEVY OF UP TO 1 MILL; DESIGNATING THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY AS THE GOVERNING BOARD; PROVIDING FOR SEVERABILITY, EMERGENCY AND EFFECTIVE DATE. WHEREAS, the Marco Island Fire Control District was created by the legislature of the State of Florida through Special Act 65-1413, and, WHEREAS, said special act limits the tax levy in this special district to i mill or $20,000, whichever is lesser in any one year, and, WHEREAS, the Marco Island co:~munity has grow~ many fold since the enactment of the special act, and, WHEREAS, the people of Marco Island need fire pro- tection services, and, WHEREAS, the amount of money needed for adequate fire protection is far in excess of $20,000, NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that: Section 1: Pursuant to Chapter 125 of the Florida District is hereby created for the purpose of providg~ protection to the residents of the area hereafter dese~be~ All that area of land located in Collier ~ty Florida, described as Marco Island, lying being situate in Township 52, South, Rangl 26, East. Section 2: Taxing Power. The Ma~o Island Fire Control Municipal Services Taxing District ~reby empowered to levy an ad valorem tax not ~O ~ceed~.m~ll in any one fiscal year. Sec~3: Governing Board, Powers and Duties. ' The=f~..~rning board of the Marco Island Fire Control Municipal So.ices Taxing District shall be the Board of 007 County Commissioners of Collier County, Florida. The Board shall possess the power and duty to conduct the affairs of the district as prescribed by law and is specifically empowered to provide services outside of the area described in Section 2, on a contractual basis. Section 4= Severability. If any portion, phrase or work of this ordinance is held invalid or unconstitutional, the remaining parts shall not be affected. Section 5: Emergency Enactment of Ordinance. The Board of County Commissioners, at its regular meeting, has waived all notice requirements of the Florida Statutes by at least a 4/Sths vote of its membership. It has found that an emergency exists and that immediate enactment of this ordinance is necessary. Section 6: Effective Date. This ordinance shall take effect upon being accepted by the Postal Authorities of the Government of United States for special delivery by registered mail to the Department of State of the State of Florida.
