AN ORDINANCE ESTABLISHING RULES AND REGULATIONS
GOVERNING T~E USE OF POTABLE WATER SYSTEM FOR
LA~N SPRINKLING WIT}~IN THE UNINCORPORATED AREAS
OF COLLIER COUNTY; AUTHORIZING THE COUNTY MANAGER
TO IMPLEMENT SAID RULES ~ND REGULATIONS; PROVIDING
FOR A PENALTY AND PROVIDING AN EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAIneD BY THE COLLIER COUNTY BOARD
OF COUNTY COF~4ISSIONERS:
SECTION ONE - PURPOSE
This Ordinance is adopted to coincide and be consistent with
the City of Naples' Ordinance No. 2531 which establishes comparable
rules and regulations within the corporate limits of the City of
Naples.
SECTION TWO - WATER USE REGULATIONS - MECHANICAL FAILURE;
INADEQUATE FACILITIES
The following rules and regulations are hereby established
governing the use of potable water from the City of Naples'
Water System for lawn sprinkling within the unincorporated
areas of Collier County. The County Manager is authorized to
implement said rules and regulations whenever he has received
written notice from the City of Naples that a mechanical failure
exists within the treatment or distribution system, or ~henever
facilities are inadequate to meet demands. Implementation shall
be predicated upon a finding by the County Manager that said
mechanical failure or inadequate facilities may affect the health,
safety, welfare or comfort of the citizens of Collier County.
Regulations:
1. Lawn sprinkling shall be permitted on Tuesday, T]~?da~,
and Saturday within the areas known as:
a. Seagate Subdivision
b. Vanderbilt Beach
c. Naples Park
d. North of State Road 846 (Immokalee Road)
e. That portion of East Naples which is South of
State Road 90 (U.S. 41)
f. South of State Road 864 (Rattlesnake Hammock Road)
2. Lawn sprinkling shall be permitted on Monday, Wednesday,
and Friday within the areas North of State Road 90 (U.S. 41) and
South of State Road 846 (Immokalee Road) except within the following
areas: Seagate Subdivision, Vanderbilt Beach, Naples Park, the
areas South of State Road 864 (Rattlesnake Hammock Road), and the
areas South of State Road 90 (U.S. 41).
SECTION THREE - I~PLE~NTATION OF SAID RULES AND REGULATIONS
The County Manager is hereby authorized and directed, upon
the implementation of the above regulations, to continue said
rules and regulations in effect and to enforce the same until
such time as he receives written notice from the City of Naples
that the condition which caused implementation thereof ceases
to exist.
The County Manager is hereby authorized, at his discretion,
to allow exceptions to the provisions hereof in cases where the
application of this Ordinance would create a hardship~ provided,
however, that the applicant for such exception shall submit in
writing an explanation of said hardship and shall agree in writing
to comply with the conditions and restrictions set by the County
Manager for said applicant.
SECTION FOUR - PENALTY
The County Mat~aqer may request the City Manager to reduce
water service to'any property for a period of thirty (30) days
for each violation of the provisions hereof. Full service will
be restored upon payment to the City of Naples of $?5.00.
SECTION V - EFFECTIVE DATE
This Ordinance shall become effective upon becoming law.
