Resolution 2011-105 RESOLUTION NO. 2011- 105 A RESOLUTION AUTHORIZING THE CONDEMNATION OF THOSE PERPETUAL AND TEMPORARY EASEMENT INTERESTS NECESSARY FOR THE CONSTRUCTION OF STORMWATER IMPROVEMENTS KNOWN AS THE US-41 DITCH SEGMENT OF THE LEL Y AREA ST01~MW A TER IMPROVEMENT PROJECT. (PROJECT NO.511(1). WHEREAS. the Board of County Commissioners desires to improve the treatment and control of storm water in the East Naples Area in order to alleviate tlooding; and WHEREAS. the Lely Area Stonnwater Improvement Projeet eonsists of improvements to an existing drainage system for an approximately 11,100 acre area loeated in East Naples, of whieh the USA I Di tch (hereinatier referred to as the "Project") is one phase; and WHEREAS, the Projeet includes the expansion of existing ditehes to improve eonveyanee and eapacity of the /low way; and WHEREAS. the Lely Area Stann water Improvement Projeet is in aecordanee with both the Capital Improvement Element and Drainage Sub-element of the Growth Management Plan; and WHEREAS, the loeation for the eonstruetion of the proposed improvements has been fixed by survey and is colleetively represented by the legal descriptions eomprising Exhibit "A" attached hereto and incorporated herein; and WI lJoREAS, after consideration of the availability of alternate routes and locations, the comparative costs of Project alternatives, various impacts upon the environment, long range planning options, and public safety considerations, the Board desires to exercise its right to condemn the property for public purposes. NOW. THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY. FLORIDA, that it has been determined by the Board that it is necessary and in the public's best interest to acquire the property described in Exhibit "A" (the "Property") for the purpose of constructing the improvements proposed as part of the US-41 Ditch segment of the Lely Area Stormwater Improvement Project located in East Naplcs. and for providing access to the improvements, in order to protect the health, safety and welfare of the citizcns of Collier County. AND IT IS FURTHER RESOLVED that acquisition of the Property and construction upon thc Propcrty is part of the County's long range planning effort to alJeviate /loading in the j'ast Naples arca. AND IT IS FURTHER RESOLVED that the Board has reviewed the staff report and considcrcd the presentation conccrning altcrnative locations for the Project. various impacts to the environment. public saJ'cty and welfare considerations associated with the design and Condemnation Resolution Project No. 5110] Page] 01'3 ~ .,., M__~~__.~,.,_~__~. .~.~^..;O___'_"M'._._~ construction of the Project, and the costs assoeiated with the design, property rights acquisition, and construction of the Project; and the Board tinds that atier consideration of these issues, the most feasible location for construction of the proposed improvements is collectively represented by the legal descriptions comprising Exhibit "A" attached hereto and incorporated herein. AND IT IS HJRTHER RESOLVED that the perpetual, non-exclusive drainage easements include the right to place and/or excavate materials lor the purpose of constructing, operating, and maintaining drainage structures and facilities, including but not limited to ditches, swales, earthen berms, rip-rap and retaining wall systems, underground pipes, culverts and various types of water control structures within the easement areas. These easements also include the right to remove and use any and all excavated material and the right to perpetual maintenance of drainage facilities thereon and adjaeent thereto. AND IT IS FURTHER RESOLVED that the temporary construction easements include the right to eonstruct drainage faeilities within the public right-of-way immediately adjacent thereto and to restore driveways beyond the existing USAI right-of-way. These easements also include the right to remove and use any and all exeavated material. AND IT IS FURTHER RESOLVED that foresaid easement interests, more fuIly deseribed in Exhibit "A" attaehed hereto and incorporated herein, are necessary for the eonstruction of the USA I Ditch segment of the Lely Area Stormwater Improvement Project. AND IT IS FURTHER RESOLVED that all of the Property shall be put to publie purposes. AND IT IS FURTHER RESOLVED that County statT is hereby authorized to immediately acquire by gift, purchase or condemnation, in accordance with the provisions of Chapters 73. 74 and 127, Florida Stall/Ie.\', the real property interests more partieularly described in Exhibit "A", attached hereto and incorporated herein. AND IT IS FURTHER RESOLVED that no mobile homes are located on the Property and therctore it will not be necessary to remove any mobile homes from the Property to be acquired.
