Due to the lack of a quorum at the June 20, 1996 HAAB meeting, the Hispanic Board was
unable to formulate a Board recommendation regarding the applicants for vacancies on the
HAAB. It was the consensus of those present that the names of the applicants should be
submitted to the Board of County Commissioners for consideration and/or approval without
waiting for the next HAAB meeting to occur. Please go forward with the appointment process
in regard to the applicants under consideration.

Dear Collier COlUlty Commissioners:
I am writing this letter to inform you that after July 31, 1(96) will no longer be a member of the
Hispanic Affairs Advisory Board. Because of my academic career, this change has come about 1
will be leaving our beloved Naples sometime in August in order to attend Florida Atlantic
University this fall. It has been a privilege as well as an honor to have served on this prestigious
board Ever since my arrival on the HAAB, lliave been treated with the highest amount of respect
and professionalism. Our involvement witllin tile community has been not only a rewarding
experience but an insightful one as well. We have been given the chance to make a difference in
Collier and we took it. Now many Hispanic citizens in tile area have more of an opport\Ulity to
voice their concems, then othelWise they would have done. As 1 leave for F AU, I will remember
all of tile fond memories shared while trying to benefit the community. If anything, my
involvement with tile HAAB has provided me with the kind of quality experience that any future
leader could have asked for. I am forever indebted to tile commissioners for giving me the
opport\mity to work Witll some of tile most respectable people I've come to know. I will leave here
knowing tlmt the voice of the Hispanic comnllUlity in Collier is being represented accurately.

WHEREAS, it is the desire of the Board of County
SECTION ONE. creation of the Hisoanic Affairs Advisorv Board.
The Hispanic Affairs Advisory Board (hereinafter referred to
as the "Board'.) is hereby created..
SECTION TWO. ADDointment and Comoosition.
A.. The Board shall be composed of seven (7) members to be
appointed by resolution of the Board of County Commissioners.
B.. Members of the Board shall be appointed by and serve at
the pleasure of the Board of County commissioners. Said members
shall be permanent residents and electors of Collier County.
CoO Appointment of members to the Board shall be by
resolution of the Board of county Commissioners, which resolution
shall set forth the date of appointment and the term of office.
SECTION THREE. Terms of Office.
The initial terms of office of the Board members shall be as
follows:
A. Three (3) members shall serve for two (2) years.
B. Two (2) members shall serve for three (3) years.
C. Two (2) members shall serve for four (4) years.

Thereafter, each appointment or re-appointrncnt shall b,.. . or .\

term of four (4) years. A member of the Goard may be re-appointed
by the Board of ,County commissioners for one (1) successive ter~.
However., other qualified applicants may be considered for any
vacancy. Appointments to fill any vacancies on the Board shall be
for the remainder of the unexpired term of office.
SECTION FOUR. Removal From Office: Failure to Attend Meetinas.
A. Any member of the Board may be removed ~rom office, with
Jr without cause, by a majority vote of the Board of county
Commissioners.
B. If any member of the Board fails to a~~end tw~ (2)
consecutive Board meetings without a satisfactory excuse or if a
member is absent from more than one-half of the Board's meetings
in a given fiscal year~ the Board shall declare the member's seat
to be vacant and the vacancy shall be filled by the Board of
County Commissioners.
SECTION FIVE. ~Officers: Quorum: Rules of Procedure.
A.. Annually the membership of. the Board shall elect a
chairman and vice chairInan from ampng the members. Of.ficers'
terms,shall be. for one (1) year with eligibility for re-election.
B. The presence of four (4) or more members shall constitute
a quorum of the Commission necessary to take action and transact
business. In addition, an affirmative vote of four (4) or more
members shall be necessary in order to take official action,
regardless of whether four (4) or more members of the Commission
are present at. the meeting.
c. The Board shall, by majority vote of the entire
membership, adopt rules of procedure for the-transaction of
business and shall keep a written record of meetings, resolutions,
findings and determinations. Copies of all Board minutes,
resolutions, reports, and exhibits shall. be submitted to the Board
of County commissioners.
D. All Board meetings shall be open to the public.

SECTION SIX. Reimbursement of Exoenses.
Members of the Board shall serve without compensation, but ,~~
shall be entitled to receive reimbursement for expenses reasonably
incurred in the performance of their duties upon prior approval of
the Board of County commissioners.
SECTION SEVEN. Functions. Powers and Duties of the Board.
__...~'!:t:e functions,. powers and duties of the Board shall be as
follows:

A.. -The Board shall identify and evaluate problems unique to
the Hispanic commun~ty.
8. The Board sball review and recommend ways to ~nsure open
communication between minorities and Collier County
government to help promote and foster better understanding by

Collier County of the problems facing the minority
population.
C. The Board shall provide periodic reports directly to the
.Bo~:d of County Commissi~ners for review.
D. The Board may and is encouraged to have joint meetings
with the Black Af~airs Adviso~ Board when deemed necessary
to evaluate problems common to both the Hispanic and Black
communities.
SECTION EIGHT. Duties of the Countv Manacer and His Desicnees.
The duties of the County Manager and His Designees shall be
to serve as Staf~ advisers and advise the Board on county
procedures and provide technical support.
SECTION NINE. . Review Process.
This Board shall be reviewed once every four (4) years
commencing in 1995, in accordance with the procedures contained in
Collier County Ordinance No. 86-41.
SECTION TEN. Conflict and Severabilitv.
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this

SECTION ELEVEN. Effective Date.
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.

Community Hospital Language Restriction Policy
Dear Ladies and Gentlemen:
The Hispanic Affairs Advisory Board of Collier County was
appointed in 1991 by the County Commission to identify areas of
concern unique to the Hispanic Community of Collier County and to
make recommendations to the Commission to properly address such
concerns. In compliance with this mission this Board holds
monthly public meetings allowing members of the community to
voice their concerns, problems and needs. As a result, the Board
initiates a process of fact finding and investigation in the area
of concern with parties believed to be part of the subject
issues.
During our last meeting on February 29, 1996, members of the
public brought to our attention a certain unwritten policy, that
Naples Community Hospital recently made public in the local
newspaper, under which you prohibit your employees from speaking
languages other than English. Given the fact that in certain
circumstances, a significant number of Hispanics are employed by
Naples Community Hospital at different levels and that Naples
Community Hospital provides medical services to people of diverse
nationalities and cultures, we perceive such a restrictive policy
to be a threat to the best interest of our local economy, culture
and use of our autochthonous language.
It is the purpose of this letter to request that a meeting
be scheduled within the next ten days, at a mutually convenient
time, with representatives of Naples Community Hospital's

directors, executi ve management and this Board to openly and
fully discuss this unwritten policy and related concerns. Chief
Assistant County Attorney Ramiro Maf'ialich is the County staff
liaison to the Hispanic Affairs Advisory Board. Please respond
to this request by calling HAAB Chairman, Frank Rodriguez at
435-7635 during regular office hours and/or providing a written
confirmation for the meeting through the Office of the County
Attorney at 3301 East Tamiami Trail, Naples, Florida 33962.
