AN ORDINANCE PROVIDING FOR THE LEGAL HOURS OF
SALE OF ALCOHOLIC BEVERAGES IN THE UNINCORPORATED
AREAS OF COLLIER COUNTY; PROVIDING FOR DEFINITIONS;
PROVIDING FOR REPEAL OF COLLIER COUNTY ORDINANCE
NO. 76-47; PROVIDING FOR A PENALTY AND PROVIDING
FOR AN EFFECTIVE DATE.
W%{EREAS, a need exists for the regulation of times of
opening and closing establishments wherein alcoholic beverages
are sold within the unincorporated areas of Collier County;
and
WHEREAS, the Board of County Commissioners has been
given authority under Florida Statute 562.14(1) to promulgate
such regulations.
NOW, THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
SECTION ONE: Definitions.
As used in this Ordinance
(1) "Alcoholic Beverages" means all beverages containing
more than one percent of alcohol by weight.
(2) "Sold" means any transfer of an alcoholic beverage
for a consideration, or the serving of an alcoholic beverage
by a club licensed under Title XXXII, Florida Statutes
(1977).
SECTION TWO: Hours of Sale.
No alcoholic beverages may be sold, consumed, served,
or permitted to be served or consumed in any place ho~ing.~ -T1

the hours of 2 A.M. and 7 A.M. Provided, however, th~ hou~ ~
of prohibition for January 1 of each year shall be 5 ~.M. t~=
7 A.M. Said hours of prohibition shall only apply to the
unincorporated areas of Collier County.
SECTION THREE:
Collier County Ordinance No. 76-47 is hereby repealed.
SECTION FOUR: Penalty.

by law for the violation of county ordinances. Each sale of
an alcoholic beverage which occurs outside of the herein
established legal hours shall constitute a separate violation
of this Ordinance. Prosecution as a misdemeanor shall not
preclude other remedies available in law and equity.
SECTION FIVE: Effective Date.
This Ordinance takes effect immediately upon receipt of
the official acknowledgement from the Office of the Secretary
of State of Florida that this Ordinance has been filed with
said office.
