Ordinance 78-55 ORDINANCE NO. 78-95
AN EMERGENCY ORDINANCE A~NDING COLLIER COUNTY ORDINANCE
NO. 78-02 BY PROVIDING FOR AN EXTENSION OF TIME WITHIN
WHICH TO RENEW VALIDLY ISSUED CERTIFICATES OF COMPETENCY;
PKOVIDING FOR CONFLICTS; SEVERABILITY AND EFFECTIVE DATE.
WHEREAS, Collier County Ordinance No. 78-02 requires that,'
all certificates of competency be renewed by midnight on
September 30th of each even numbered year; ando
WHEREAS, a significant number of compete~_,_~ard h_~_lders
have failed to renew their Certificate of Com~i~uy by~h~
required deadline; and
would
incur a significant hardship if all of those ~divfdua~ currently
holding a 1978 Certificate of Competency card were required tO
make reapplication;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA:
SECTION ONE:
Collier County Ordinance 78-02 is amended by creating a new
§1.5.4 to read:
1.5.4 Any individual failing to renew his
competency certificate prior to midnight on
September 30th of each even numbered year
shall have until midnight December 31st of'~
each even numbered year to renew his certi
cate of competency, provided however, a pens&~ty
of ten percent of the.required fee is provide.
for in §1.8 shall be assessed.
SECTION TWO:
Section 1.5.5 should September 30th or December 31st be a
Saturday, Sunday or legal holiday the renewal period shall not
cxpire until midnight of the next following working day.
SECTION THREE:
Scction 1.5.4 is renumbered to 1.5.6 and amended to read:
1.5.6 Any individual failing to renew his
competency certificate prior to its expiration
shall be required to make reapplication pursuant
=o Part II of Collier County Ordinance 78-02.
SECTION FOUR:
It is declared to be the intent of the Board of County
Commissioners of Collier County that if any section, subsection~.
sentence, clause, phrase, or provision of this Ordinance is held
invalid or unconstitutional such invalidity or unconstitutionality
shall not be so construed as to render invalid or unconstitutional
the remaining provisions of this Ordinance.
SECTION FIVE: Emergency and Effective Date.
The Board of County Commissioners at its Regular Meeting has
waived all notice requirements of the Florida Statutes by at
least 4/Sths vote of its membership. It has found that an
emergency exists and that immediate enactment of this Ordinance
is necessary.
The Clerk of the Board of County Commissioners is hereby
directed to cause to be filed with the Department of State
certified copies of this Ordinance as soon as is practicable.
This Ordinance shall take effect upon being accepted.b~..the
postal authorities of the government of the United States for
special delivery by registered mail to the Department of State.
