SECTION ONE.' Pursuant to Chapter 125 of the Florida Statutes',
the Marco Island Lighting Municipal Service Taxing District is
hereby created for the purpose of providing lighting to the
residents of the area hereinafter described:
All that land located in Collier County, Florida, and
specifically described as:

SECTION TWO: The governing body of the District shall be ex
officio the Board of County Commissioners of Collier County,
Florida.
SECTION THREE: The District is formed for the purpose of providing
street lighting in the above described areas and to that end
shall possess all the powers to do all things reasonably necessary
to provide such services, including ownership or rental of property,
poles, wires, conduits, lights, meters, and the power to maintain
the same and to enter into contracts for providing the same and
the electric current to operate any lighting system therein
installed.
SECTION FOUR: For the purpose of carrying into effect this
Ordinance, the Board of County Commissioners shall annually, at
the time required by general budgetary law, make an itemized
estimate of the amount of money required to carry out the business
of the District for the next'fiscal year, which shall be from
October I to and including September 30 following. The estimate
shall have for what purpose the monies are required and the

amount necessary to be raised by taxation within the District.
At the time and place for fixing the annual rate of taxation for
county purposes, the Board shall fix and cause to be levied on
all property within the District subject to taxation a millage
sufficient to meet the requirements of the estimate; provided,
however, the total millage shall not exceed one (1) mill.
SECTION FIVE: Taxes herein provided for shall be assessed and
collected in the same manner and form as provided for the assess-
ment and collection of general county taxes and subject %o the
same fees for assessing and collecting as general county.taxes.
SECTION SIX: Passage of this Ordinance will amend Ordinance 72-
1, as amended, by deleting the aforementioned lands from the
Collie~ County Lighting District without any further action of
the Board of County Commissioners of Collier County, Florida.
SECTION SEVEN: The boundaries of this district or the lands
included in said district may be changed by an amendment to this
ordinance.
SECTION EIGHT: Since the costs for lighting in this district were
budgeted in the Collier County Lighting District for
FY 77-78, these costs for the district created by this ordinance
will be paid by the Collier County Lighting District through
September 30, 1978.
SECTION NINE:
CONSTRUCTION
This Ordinance shall be liberally construed to effectuate
its public purpose.
If any portion, phrase or word of this Ordinance is held
invalid or unconstitutional, the remaining parts shall not be
affected.
