AN ORDINANCE AMENDING COLLIER COUNTY ORDINANCE
NO. 78-2; PROVIDING FOR CONFLICTS, SEVERABILITY,
EMERGENCY, AND AN EFFECTIVE DATE.
W1{EREAS, Collier County Ordinance No. 78-2 licenses
specialty contractors for the first time; and
WHEREAS, Collicr County Ordinance No. 78-2 requires
specialty contractors to show that they held Collier County
occupational licenses for the fiscal years 1974-75, 1975-76,
and 1976-77, in order to be eligible for the grandfather
provision; and
WHEREAS, experience has shown the three-year occupational
license to be unduly burdensome; and
WHEREAS, the Contractors' Licensing Board, by motion,
has recommended that any specialty contractor possessing an
occupational license on January 30, 1978 be eligible for the
grandfather provision of Collier County Ordinance No. 78-2;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that Section 2.12
of Collier County Ordinance No. 78-2 be amended by adding
the following section:
~' 2.~ In addition to the foregoing alternatives,
~ ~,~. any applicant for a specialty license, as
o defined under Section 1 7.17 of Collier

~ County Ordinance No. 78-2, shall not be
o required to take a qualifying examination
if on the effective date of Ordinance
No. 78-2 the applicant, or its qualify-
ing agent, possessed an occupational
license for Collier County in the specialty
trade for which application is made.. In
order to qUalify for his exemption, the
applicant must make application for a
Certificate.of Competency between the
dates March 31, 1978 and May 1, 1978.
SECTION TWO: Conflict.
In the event this Ordinance conflicts with any other
ordinance of Collier County or any municipality therein or
other applicable law, the more restrictive shall apply.
SECTION THREE: Severability.
It is the intention of the Board of County Commissioners
that each separate provision of this Ordinance shall be
deemed independent of all provisions herein, and it is
further the intention of the Board of County Commissioners
that if any provision of this Ordinance be declared to be
invalid, all other provisions shall remain valid and enforce-
able.
SECTION FOUR: Emergency and Effective Date.
The Board of County Commissioners at its Regular Meeting
has waived all notice requirement~ of the Florida Statutes
by at least 4/Sths vote of its membership. It has found
that an emergency exists and that immediate enactment of
this Ordinance is necessary.
This Ordinance shall take effect upon being accepted by
the postal authorities of the government of the United
States for special delivery by registered mail to the
Department of State.
