In accordance with the 2004 Florida Building Code any building or structure or any individual member with any of the structural conditions or defects described below shall be deemed dangerous. A check mark next to any paragraph below is an indication one or more of the dangerous structural conditions have been found. [8J 1. The stress in a member or portion thereof due to all factored dead and live loads is more than one and one third the nominal strength aflowed in the Florida Building Code, Building for new buildings Df similar. structure, purpose, or location. [8J 2. Any portion, member, or appurtenance thereof is likely to fall, or to become detached or dislodged, or to collapse and thereby injure persons. [8J 3. Any portion of a building, or any member, appurtenance, or omamentation on the exterior thereofis not of sufficient strength or stability, or is not anchored, attached, or fastened in place so as to be capable of resisting a wind pressure of two thirds of that specified in the Florida Building Code, Building for new buildings of similar structure, purpose, or location without exceeding the nominal strength pennitted in the Florida Building Code, Building for such buildings. [8J 4. The building, or any portion thereof, is likely to collapse partiafly or completely because of dilapidation, deterioration or decay; construction in violation of the Florida Building Code, Building; the removal, movement or instability of any portion of the ground necessary for the purpose of supporting such building; the deterioration, decay or inadequacy of its foundation; damage due to fire, wind or flood; or any other similar cause. [8J 5. The exterior walls or other vertical structural members list, lean, or buckle to such an extent that a plumb line passing through the center of gravity does not fafl inside the middle one third of the base. The field inspection revealed the building satisfied one or more of the conditions noted above. Based on the inspection findings the building was found to be dangerous and unsuitable for the safe occupancy of its intended purpose. Immediate remediation of the conditions up to and including demolition of the structure are required. COMMENTS: The structure has been totally destroyed by fire. The heat was so great that the tie beam has cracked. A Florida Design Professional shall evaluate if any portion can be salvaged for future construction, This structure was inspected by Structural Inspector Tim Stick on 2/3/1]. In consideration of the disposition and resolution of the matters outlined in said Notice(s) of Violation for which a hearing is currently scheduled fOT May 3"', 2011; to promote efficiency in the administration of the code enforcement process; and to obtain a quick and expeditious resolution of the matters outlined therein the parties hereto agree as follows: 1) The violations noted in the referenced Notice of Violation are accurate and I stipulate to their existence. The violations are of Florida Building Code, 2007 Edition, Chapter 1, Section 105.1, and described as unpermitted wood and chain link fence. THEREFORE, it is agreed between the parties that the Respondent shall; 1) Pay operational costs in the amount of $112.12 incurred in the prosecution of this case within 30 days of this hearing. 2) Abate all violations by: Must apply for and obtain all permits; inspections; and certificates/occupancy required for fence or for the removal of the fence within (DO days of this hearing or a fine of $100 for each day the violation continues. 3) Respondent must notify Code Enforcement within 24 hours of abatement of the violation and request the Investigator perform a site inspection to confirm compliance. (24 hours notice sIlall be by phone or fax and made duOng the workweek. If the vloIi!Ition i3 lIbetecl 24 hour's prior to a Saturday.
