WHEREAS, Mr. William R. Vines, agent for Concord, H. C.
Gockenbach, Trustee, petitioned the Board of County Co~u,issioners
to change the Zoning Classification of the herein described real
property;
NOW, THEREFORE BE IT ORDAINED by the Board of County Com-
missioners of Collier County, Florida:
SECTION ONE:
The Zoning Clasiification of the herein described real
property is changed from "A" Agriculture to "PUD" Planned Unit
Development and is subject to all the conditions as required
herein and the Zoning Atlas Map Number 48-25-2 as described in
Ordinance 76-30 is hereby amended accordingly:

DISTRICT ZONE: PUD
PERMITTED USES: Multi-family dwellings, recreation areas and facilities.
PERMITTED ACCESSORY USES AND STRUCTURES: Accessory uses and
structures customary In multi-family residential neighborhoods;
recreation facilities which are accessory to Individual building sites,
groups of building sites, or the Cypress Lakes project as a whole;
signs as permitted by the Collier County Zoning Regulations in multi-
family residential districts; grounds and equipment maintenance faci[itles
on the maintenance site Indicated on the Master Plan.
PROVISIONAL USES: Churches, schools, child care centers, civic and
cultural facilities.
MAXIMUM GROSS PROJECT DENSITY: 3.55 dwelling units per acre.
Total dwelling unit count shall not exceed 7z~0.
DEVELOPMENT STANDARDS .'
Minimum Lakefront Setbacks: ~0 feet.
Minimum Commonsfront Setbacks: 2S feet.
Minimum setback from principal east/west collector street: 25 feet.
Minimum setback from cul-de-sac and loop access drives:
Principal buildings - 25 feet; parking structures - none
(covered and uncovered parking may be integral with access
drives).
Minimum building separation: One-.half the sum of the heights of
adjoining buildings.
Minimum dwelling unit floor area: 1,200 sq.ft.
Maximum height of principal structures: 3 living storlee (ground
floor parking may occur under the first living story).
Minimum offstreet parking.' 2 cars per dwelling unit.
RECREATIONAL AREAS: 8 recreation commons and a ~+ acre neighbor-
hood peri< shall be established as Indicated on the approved Master
Plan.
MASTER PLAN: The approved CYPRESS LAKES PUD Master Plan shall
also constitute the approved Subdlvislon Master Plan,
DWELLING UNIT DISTRIBUTION: Dwelling unit distribution throughout
the CYPRESS LAKES project shall occur as Indicated on the Master
Plan. Upon site plan approval by the Director of the Department
of' Community Development, minor changes In the number of dwelling
units permitted on Individual building sites and/or In Individual
building site boundaries shall be permitted, so long as the total
project dwelilng unit count does not exceed 740.
MAINTENANCE: Prior to project development, arrangements for continuing
maintenance of the project lakes, water management facilities, roads,
and other common areas shall be set forth In County enforceable
documents and approved by the County Engineer.
ROADWAY IMPROVEMENTS: Where the principal project collector street
Intersects with U.S.~I1 and with C-901, developer Installed project
Improvements shall Include left-turn storage lanes for north-bound
U.S.~I traffic, and for south-bound C-901 traffic; and right-turn
deceleration lanes for south-bound U.S.~I traffic and north-bound
C-901 traffic.
if a future determination is made by the County Engineer and DOT
that a traffic signal is warranted at the intersectlon of the project's
principal access road and U.S.~I, the Cypress Lakes property
owners shall pay for or contribute to the capital Costs of sald
traffic signal in accord wlth the County cost sharing policy then
in force. After Installation, the signal will be owned, operated, and
maintained by the County.

EXCEPTIONS TO THE COUNTY SUBDIVISION REGULATIONS:
Article X, Section 16:
The requirement for sidewalks and bicycle paths shall be
waived, and sldewalk/blcycle paths shall be Installed as
indicated on the approved Master' Plan.
Article X, Section 19:
Street name signs shall be approved by the County Engineer',
but need not meet the U.S.D.O.T.F.H.W.A. Manual on Uni-
form Traffic Control Devices. Street pavement painting,
striping, and reflective edging requirements shall be '~alv~c[.
Article XI, Section 1:
The requirement that local street connections to collector
streets shall be a minimum of 660 ft. apart shall be waived.
Article XI, Section 17 F:
Right of way width for the private local drives may bm 50 ft.
rather than 60 ft.
Article Xi, Section 17 J:
The requirement that curbed streets have a minimum tangent
of 100 ft. at Intersections shall be waived.
Article XI, Section 17 K:
The requirement for 100 ft. minimum length tangents between
curbs on all streets shall be waived.
Article Xi, Section 21:
The requirement for spare utillty casings shall be waived,
with the exception of utility casings under' the project
principal access road at Its lntersectlons with U.S.~I and
C-901.
