AN ORDINANCE PROHIBITING THE SALE OF NARCOTIC
RELATED PARAPHERNALIA; PROVIDING FOR DEFINITIONS
FOR THE TERMS USED HEREIN; PROVIDING FOR PENAL-
TIESi PROVIDING FOR SEVEraNCE, AND EFFECTIVE
DATE.
BE IT ORDAINED BY THE BOARD OF COUNTY CO~ISSIONERS OF
COLLIER COUNTY, FLORIDA as follows:
Sec=ion 1. For the purposes of this Ordinance the follow£ng
words and terms shall have the meaning respectfully ascribed
them aa follows~
A. Controlled Substances: Shall mean any substance named
described in Section I through V of J893.03, Florida
B.' NarcoCta-RelaCed Paraphernalia= Shall mean any machine,
instrument, tool, equipment, contrivance or device intended by
the seller Co be used for one or more of the following purposes:
(1) To introduce into the human body any controlled
substance or substances under circumsCan~ip~in vi~-~.on

(2). To enhance the effect on the

subs=ance or subs=ancas under circ~s=ances in viola-

(4) To =es= the streng=h, effec=~veness, purity,
or weish= of any con=rolled oubs=ance or subs=an~s
under ci=c~8=ances ~n viola=ion of =ha laws of ~e ~

C. ~a~e: Shall mean =o lend, 8ire away, deliver, .~ ~ ~
exchanse or =ransmi=, wi=h or wi=hour conside=a=ion. ~ ~
Sec=~on 2. I= is unlawful fo= any person =o sell, possess
wi=h ~n=en= =o sell, or offer for sale any narco=lc-reid=ed
paraphe~alia.
Sec=~on 3. Pres~9~ion: The know~n8 possession by any
person, of =en (10) or more iden=ical or similar items of narco=~c-
rela=ed paraphe~al~a as defined in =his Ordinance, shall be

prima facia evidence of a violation of this Ordinance.
Sec=ion 4. Any person who viola=es =his Ordinance or an7
provision =hereof, or fails =o comply =herewith or with any
requirements thoreof, or does any=bins prohibi=~d herein, or does
any ac= declared unlawful by =his Ordinance or any provision
=hereof~ shall upon conviction be punished as provided by law for
=he violation of County ordtnances.
Section 5. If any sec=ion, clause, or provision of this
Ordinance be declared unconstitutional or held invalid, i= shall.
not affect any other section, clause or provision =hereof, bug
the same shall remain ~n full force and effect.
Section 6. This Ordinance shall become effect£ve upon
receipt of notice that i~ is filed with =he Secretary of State.
