WHEREAS, the Legislature of' the State of F10tida in Chapters'
67-1246 and 125, Florida BtatutU, haa conferred on 811counUe.in
Florida the power to establish, ~oordiriate and enforce zonina snd such
business regulations as are necessary for the protection of the public;
WHEREAS. The County. pursuant thereto has adopted a Comprehensive
Zoning Ordinance establishing regulations for the zoning of particular
geographic divisions of the County, among which is the granting of
provisional usee; and
WHEREAS. the Coastsl Area Planning Commission, being the duly
appointed and constituted planning board for the area hereby affected,
has held a public hearing after notice as in said regulation. made and
provided, and haa considered the adviubil1ty ofProvis1onal Use tie"
in a Estates zone for the property hereinafterd..cribed, and bas found
8S a matter of fact that satisfactory provision and arrangement baa
been made concerning all spplicable matters required by said regulations
and in accordance with Section 13 .. 1d of th41 Zoning Regulations for the
Coastal Area Planning Commission; and
WHEREAS, all interested parties have been given opportunity to be
heard by this Board in public meeting assembled and the Board having
considered all matters presented.
NOW, THEREFORE BE IT RESOLVED. by the Board of ZONING APPEALS of
Collier County, Florida that the petition of

AGREEMENT
t, Dennis Lynch, as owner or authorized agent for Peti.tion
agree to the following stipulations requested by the ~asta1 Area
Planning Commission in their public hearing on Apri1~, 1984:
A. Detailed site drainage plans shall be submitted to the County
Engineer for review. No construction permits shall be issued unless
and until approval of the proposed construction in accordance with
the submitted plans is granted by the County Engineer.
B. Petitioner shall submit to the County Engineer, a Water Management
to accomodate a 25-year!24-hour design storm event.
C. An excavation permit will be required for the proposed lake in
accordance with Collier County Ordinance No. 80-26, as amended by
Ordinance No. 83-3.
D. The 33 foot setback area shall be kept in natural vegetation.
E. A final site plan shall be submitted with the,tennis and basketball
courts and the baseball field relocated out of the setback are. and
the parking as required by the Zoning Ordinance.
