RESOLUTION NO. 93~
RESOLUTION AUTHORIZING FINAL ACCEPTANCE OF THOSE
ROADWAY, DRAINAGE, WATER AND SEWER IMPROVEMENTS IN
MARCO SHORES UNIT ONE, RELEASE OF THE MAINTENANCE
SECURITY, AND ACCEPTING THE MAINTENANCE RESPONSIBILITY
FOR THE ROADWAY, DRAINAGE, WATER AND SEWER
IMPROVEMENTS THAT ARE NOT REQUIRED TO BE MAINTAINED BY
THE HOMEOWNERS ASSOCIATION.
WHEREAS, the Board of County Commissioners of Collier County,
Florida, on October 22, 1985, approved the plat of Marco Shores Unit
One for recording; and
WHEREAS, the developer has constructed and maintained the
roadway, drainage, water and sewer improvements in accordance with
the approved plans and specifications and as required by the Land
Development Code (Collier County Ordinance No. 91-102, as amended);
and the utilities Standards and Procedures Ordinance (Collier County
Ordinance No. 88-76, as amended), and
WHEREAS, the developer has now requested final acceptance of
the roadway, drainage, water and sewer improvements and release of
his maintenance security; and
WHEREAS, the Compliance Services Section of Development
Services Department has inspected the roadway, drainage, water and
sewer improvements and is recommending acceptance of said
facilities.
NOW, THEREFORE, BE IT RESOLVED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that final acceptance be
qranted for those roadway, drainaqe, water and sewer improvements in
Marco Shores Unit One, and authorize the Chairman to execute the
attached SatiSfaction of Mortgage.
BE IT FURTHER RESOLVED AND ORDERED that the County accept the
future maintenance and other attendant costs for the roadway,
drainage, water and sewer improvements that are not required to be
maintained by the homeowners association.

KNOW ALL MEH BY THESE PRESENTS, that COLLIER COUNTY,
FLORIDA, a political subdivision of the State of Florida, as
"Mortgagee", owner and holder of that certain Mortgage executed
by THE DELTONA CORPORATION, a Delaware Corporation, authorized to
transact business in the State of Florida as "Mortgagor", bearing
date the 26th day of August, 1986, and recorded in Official
Records Book 715, at Pages 452 through 456 inclusive, of the
Public Records of St. Johns County, Florida, said mortgage
partially securing for completion of Subdivision Improvements in
accordance with the terms and conditions of that certain
Agreement for Construction .and Maintenance of Subdivision
Improvements between The Deltona Corporation and the Board of
County Commissioners of Collier County, Florida, as approved by
the board at regular aqenda on August 26, 1986, representing a
principal obligation of $221,250.00 and other certain promises
and obliqations set forth in said mortgage, encumbering the
property situate in State of Florida and the County of St. Johns
being more partiCUlarly described as follows, to wit;

AND BY REFERENCE MADE A PART HEREOF)
WHEREAS, COLLIER COUNTY, FLORIDA, a political subdivision of
the State of Florida, as Mortgagee, does hereby acknowledqe full
payment an satisfaction of said Mortqaqe and hereby surrenders
the same as cancelled and directs the Clerk of the Circuit Court
of St. Johns County to cancel the same of record.
