NOW~ ~REFORE, BE IT O~AI~D~ by the Board of County Co~ls-
,ioners of Collier County, Florida th&t:
SECTION ONE:
The Zoning Ordinance 74-15 is hereby amended as follows:
1. A~end Article V by adding, a new Section 5.10 which reads aa
follows:
Section 5.10 Required buffer between Res~d~nti~l zoned pro-
pC, try and Coe~erCial or Industrial zoned pr0p~rty. In cases
where comercial or industrial zoned property abuts property
zoned for residential uses, there shall be provided a land-
sca~ed buffer area designed and planted so as to be eighty
(80) percent opaque when viewed horizontally at three (3) feet
above ground level, and said plant materials should ~each a
height of five (5) feet within two years after planting. A
fifteen (15) foot wide landscaping ares may be substituted for
the required three (3) foot high planted buffer. Such land-
scaped buffer shall be located between the co.on lot line of
the residential zoned lot and the common lot line of the
comercial activity or off-street parking area exposed to the
abutting residential property so that the purpose of screening
the comercisl ares is Icco~plished, If this buffe~ is lo-
e~ted on or within s utility easement, the maximu~ height of
the vegetative buffer shall be fifteen (15) fee~.
This provision shall apply to all property rezoned after
the effective date of this ordinance.
In the case where a parcel of land is rezoned from com-
mercial or industrial zoning to residential zoning, then the
residential zoned property shall provide the Buffer.
In the cane where a parcel of land is rezoned from resi-
dential zoning to commercial or industrial zoning, then the
commercial or industrial zoned property shall provide the
buffer.

ordinance.
