AN ORDINANCE CREATING THE EAST NAPLES FIRE HYDRANT MUNICIPAL
SERVICE TAXING DISTRICT; PROVIDING THE BOUNDARIES OF THE
DISTRICT; DESIGNATING THE GOVERNING BODY OF THE DISTRICT;
AUTHORIZING A TAX LEVY AS PROVIDED BY LAW; PROVIDING FOR
CONSTRUCTION AND AN EFFECTIVE DATE.

SECT]ON ONE: Pursuant to Chapter 125 of the Florida Statutes:,!th~ East NaP~res Fire
HydranL Municipal Service' Taxing District is hereby created f~)r'~)t.~ purpo_~se ~ providing

fire hydrants to the residents of the district. Thts district' sha~l be ~em~ a
municipal service taxing or benefit unit as the same are delineated by S~tton 1:~5.01(q),
Flortda Statutes.
SECTION TWO: The district boundaries shall be as follows:
A part of Section 11 and a part of the South Half of
Section 2, Township 50 South, Range 25 East. Collier
County, Florida and bounded by Rock Creek to the North~_ ~
Airport Road to the East, Haldeman Creek to the South ~
and. Sandpiper Street to the West. ~ --= ,=.=
SECTION THREE: This District is formed for the purpose of provtdtng~tre h a tn
the above described tract of land. ~ ~
SECTION FOUR: The governing body of.the dtstrtct shall be ex officio the Board of
County Commissioners of Collier County, Florida. The Board shall have the power to do
all things reasonably necessary to carry out the purpose of t).e district.
SECTION FIVE: For the purpose of carrying into effect this Ordinance, the Board of
County Commissioners shall annually, at the time required by general budgetary law,
make an itemized estimate of the amount of money required to carry out the business
of the District for the next..fiscal year, which shall be from October 1 to and
including September 30 following. The estimate shall have for what purpose the monies
are required and the amount necessary to be raised by taxation within the district. At
the time and place for fixing the annual rate of taxation for county purposes, the
Board shall fix and cause to be levied on all property within the district subject to
taxation a millage sufficient to meet the requirements of the estimate; provided,
however, the total millage shall not exceed the millage authorized by law for municipal
service taxing or benefit units.
SECTION SIX: Taxes herein provided for shall be assessed and collected in the same
manner and form as provided for the assessment and collection of general county taxes
and subject to the same fees for assessing and collecting as general county taxes.
SECTION SEVEN: This Ordinance shall be liberally construed to effectuate its
public purpose.
If any portion, phrase or word of this Ordinance is held invalid or unconstitu-
tional, the remaining parts shall not be affected,
