AN ORDINANCE PRORIBITING CAMPING DURING THE
NIGHT TIME ON THE RICHT-OF-WAY OF THE W. J.
JANES MEMORIAL SCENIC DRIVE IN COLLIER COUNTY,
FLORIDA; PROVIDING A LEGAL DESCRIPTION;
REPEALING COLLIER COUNTY ORDINANCE NO. 69-2;
PROVIDING DEFINITIONS; PROVIDING PENALTIES
FOR VIOLATIONS: PROVIDING AN EFFECTIVE DATE.
WHEREAS, concern has been expressed as to the validity
of the legal description of W. J. Janes Memorial ~centc Drive
contained within Collier County Ordinance No. 69-2, and
WHEREAS, the effective enforcement of the prohibition
of camping during the night time on the right-of-way of the
W. J. Janes Memorial Scenic Drive has been hampered due to
the incomplete legal description contained within Collier
County Ordinance No. 69-2;
NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that:
Section 1. Camping during the night time on the right-of-
way of the W. J. Janes Memorial Scenic Drive, described as:

A right-of-way 100 feet in width along the so called
"Main Line" of the logging railroad used by the ~

from the SE corner of the NE-l/4 of Section 13, To~.hip
South, Range 29 East, and terminating at a point along the~
west line of Section 6, Township 51 South, Ranze 29 ~mst,
said west line also being the east line of Gol]en Ga .~
Estates.
This right-of-way is located in the following Sections,

Section 3. "Night time" as used herein means that time
between one-half hour after sunset and one-half hour before
sunrise the following morning.
Section 4. Violations of this Ordinance shall be
punished as provided by seneral law.
Section 5. Collier County Ordinance No. 69-2 is hereby
repealed in its entirety and is superseded and replaced by
this Ordinance.
Section 6. This Ordinance shall take effect upon
acknowledgement of receipt of a certified copy of this
Ordinance by the office of the Secretary of State of the
State of Florida.
