AN EMERGENCY ORDINANCE AMENDING COLLIER
c~U~TY!J.OHD~A~NCE NO. 78-2I PROVIDING FOR
CONFLICTS, '.~EVERABILITY, EMERGENCY, AND AN
"EFFECTIVE DAT~^
WHEREAS, Collier County Ordinance No. 78-2 licenmes
specialty contractors for the first time~ and
WHEREAS, Collier County Ordinance No. 78-2, as amended by
Collier County Ordinance No. 78-13, required specialty
contractors to show that they possessed a Collier County
occupational license on January 30, 1978, in order to be eligible
for the grandfather provision therein establishedl and
WIIEREAS, variances in interpretation and notification
procedures, along with confusion concerning the difference
between an occupational license and a certificate of competency,
together with the fact that prior to January, 1981, the Tax
Collector's office issued an occupational license without a
certificate of competency being required; and
WHEREAS, in order to eliminate further confusion, the
Contractor's Licensing Board, by motion, has recommended that any
specialty contractor possessing a valid Collier County
occupational license on January 30, 1978, and who has maintained
a valid Collier County occupational license for the fiscal years
1978-1979, 1979-1980 and 1980-1981, be eligible for the
grandfather provision of Colll~' County Ordinance No. 78-2~
NOW THEREFORE BE IT ORDAINED BY THE DOARD~ OF ~OUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA, that
SECTION ONE~
Section 2.12 of Collier County Ordinance No. 78-2~e
by adding the following soc~ion~
I~ addition to the foregoing alternatives, any applicant for
a ipecialty license, as defined under Section 1.7.17 of
Collier County Ordinance No. 78-2 aa amended by Collie~
County Ordinance ?B-69, shall not be required to take a
qualifying examination if~
(1) On Januar9 30, 1978, (the effective date of
Ordinance 78-2) the applicant or its qualifying
agent possessed a valid Collier County
occupational license in the specialty trade for
which application is made, and
(2} Such occupational license has been validly renewed
and maintained for the fiscal years 1978-1979,
1979-1980 and 1980-1981.
In order to qualify for the exemption, the applicant must
make ~pplication for a certificate of competency on or before
September 30, 1982.
SECTXON TWOt Conflict & Severability
(a) In the event this Ordinance conflicts with other
applicable law, the more restrictive shall apply. If
any portion of this Ordinance is in conflict with an
ordinance of any municipality within Collier County, it
shall not be effective within the municipality to the
extent of such conflict.
(b) If any section, subsection, sentence, clause, phrase,
or ~ortion of this Ordinance is, for any reason, held
invalid or unconstitutional by any court of competent
Jurisdiction, such portion shall be deemed a separate,
distinct and independent provision of such holding and
shall not affect tho validity of the remaining portion
thereof.
SECTION THRE~ Declaration of Emerq.gncy and Effective Date
This Board does hereby declare that an emergency exists and
that immediate enactment of this Ordinance is necessary, and by
no less than four-fifths (4/Sth) vote of the ~embership of the
Board does hereby waive notice of intent to consider this
Ordinance.
A certified copy of this Ordinance, as enacted, shall be
filed by the Clerk of the Board with tho Department of Brats of
~he State of Plorid.~ as soon altar anactmant as i. D~acticable
b~ dspositing the same with the postal authorities of the
qovernment of the United States for special delivery by certified
mall, postage prepaid, to the Florida Department of State.
This Ordinance shall become effective upon becoming law.
PASSED AND DULY ADOPTED by the Board of County Commissioners
