Damage by Dogs (Refs & Annos) ... 767.12. Classification of dogs as dangerous; certification of registration; notice and hearing re- quirements; confinement of aninni1; exemption; appeals; unlawful acts (l)(a) An animal control authority shall investigate reported incidents involving any dog that may be dangerous and shall, if possible, interview the owner and require a sworn affidavit from any person, including any animal control officer or enforcement officer, desiring to have a dog classified as dangerous. Any animal that is the sub- ject of a dangerous dog investigation, that is not impounded with the animal control authority, shall be humanely and safely confined by the owner in a securely fenced or enclosed area pending the outcome of the investigation and resolution of any hearings related to the dangerous dog classification. The address of where the animal resides shall be provided to the animal control authority. No dog that is the subject of a dangerous dog investiga- tion may be relocated or ownership transferred pending the outcome of an investigation or any hearings related to the determination of a dangerous dog classification. In the event that a dog is to be destroyed, the dog shall not be relocated or ownership transferred. -.. (b) A dog shall not be declared dangerous if the threat, injury, or damage was sustained by a person who, at the time, was unlawfully on the property or, while lawfully on the property, was tormenting, abusing, or assaulting the dog or its owner or a family member. No dog may be declared dangerous if the dog was protecting or de- fending a human being within the immediate vicinity of the dog from an unjustified attack or assault. (c) After the investigation, the animal control authority shall make an initial determination as to whether there is sufficient cause to classify the dog as dangerous and shall afford the owner an opportunity for a hearing prior to making a. [mal determination. The animal control authority shall provide written notification of the sufficient cause finding, to the owner, by registered mail, certified hand delivery, or service in conformance with the pro- visions of chapter 48 relating to service of process. The owner may file a written request for a hearing within 7 calendar days from the date of receipt of the notification of the -sufficient cause finding and, if requested, the hearing shall be held as soon as possible, but not more than 21 calendar days and no sooner than 5 days after re- ceipt of the request from the owner. Each applicable local governing authority shall establish hearing procedures that conform to this paragraph. (d) Once a dog is classified as a dangerous dog, the animal control authority shall provide written. notification to the owner by registered mail, certified hand delivery or service,. and the owner may file a written request for a hearing in the county court to appeal the classification within 10 business days after receipt of a written determ- ination of dangerous dog classification and must confine the dog in a securely fenced or enclosed area pending a @2010 Thomson Reuters. (2) Within 14 days after a dog has been classified as dangerous by the animal control authority or a dangerous dog classification is upheld by the county court on appeal, the owner of the dog must obtain a certificate of re- gistration for the dog from the animal control authority serving the area in which he or she resides, and the certi- ficate shall_be renewed annually. Animal control authorities are authorized to issue such certificates of registra- tion, and renewals thereof, only to persons who are at least 18 years of age and who present to the animal control authority sufficient evidence of: (a) A current certificate of rabies vaccination for the dog. (b) A proper enclosure to confine a dangerous dog and the posting of the premises with a clearly visible warning sign at all entry points that informs both children and adults of the presence ofa dangerous dog on the property. (c) Permanent identification of the dog, such as a tattoo on the inside thigh or electronic implantation. The appropriate governmental unit may impose an annual fee for the issuance o~ certificates of registration re- quired by this section. ,~ (3) The owner shall immediately notify the appropriate animal control authority when a dog that has been classi- fied as dangerous: (a) Is loose or unconfmed. (b) Has bitten a human being or attacked another animal. (c) Is sold, given away, or dies. (d) Is moved to another address. Prior to a dangerous dog being sold or given away, the owner shall provide the name, address, and telephone number of the new owner to the animal control authority. The new owner must comply with all of the require- ments of this act and implementing local ordinances, even 1f the' animal is moved from one local jurisdiction to another within the state. The animal control officer must be notified by the owner of a dog classified as danger- ous that the dog is in his or her jurisdiction. (4) It is unlawful for the owner of a dangerous dog to permit the dog to be outside a proper enclosure unless the dog is muzzled. and restrained by a substantial chain or leash and under control of a competent person. O&mt= Florida&fn= _ top&... 12/15/2010 Page 4 of7 West's F.SA S 767.12 Page 3 ,-'" muzzle must be made in a manner that will not cause injury to the dog or interfere with its vision or respiration but will prevent it from qitingany person or animaL The owner may exercise the dog in a securely fenced or en- closed area that does not have a top, without" a muzzle or leash, if the dog remains within his or her sight and only members o(the immediate household orpersons 18 years of age or older are allowed in the enclosure when the dog is present. When being transported, such dogs must be safely and securely restrained ~ithin a vehicle. (5) Hunting dogs are exempt from the provisions of this act when engaged in any legal hunt or training proced- ure. Dogs engaged in training or exhibiting in legal sports such as obedience trials, conformation shows, field trials, hunting/retrieving trials, and herding trials are exempt from the provisions of this act when engaged in any legal procedures. However, such dogs at all other times in all other respects shall be subject to this and local laws. Dogs that have been classified as dangerous shall not be used for hunting purposes. (6) This section does not apply to dogs used by law enforcement officials for law enforcement work. (7) Any person who violates any provision of this section is guilty of a noncriminal infraction, punishable by a [me not exceeding $500. Definitions As used in this act, unless the context clearly requires otherwise: (1) "Dangerous dog" means any dog that according to the records of the appropriate authority: (a) Has aggressively bitten, attacked, or endangered or has inflicted severe injury on a human being on public or private property; (b) Has m.ore than once severely injured or killed a domestic animal while off the owner's property; (c) Has been used primarily or in part for the purpose of dog fighting or is a dog trained for dog fighting; or , --.... (d) Has, when unprovoked, chased or approached a person upon the streets, sidewalks, or any public grounds in a menacing fashion or apparent attitude of attack, provided that such actions are attested to in a sworn statement by one or more persons and dutifully investigated by the appropriate authority. (2) "Unprovoked" means that the victim who has been conducting himself or herself peacefully and lawfully has been bitten or chased in a menacing fashion or attacked by a dog. (3) "Severe injury" means any physical injury that results in broken bones, multiple bites, or disfiguring lacera- tions requiring sutures, or reconstructive surgery. (4) "Proper enclosure of a dangerous dog" means, while on the owner's property, a dangerous dog is securely confmed indoors or in a securely enclosed and locked pen or structure, suitable to prevent the entry of yoimg children and designed to prevent the animal from escaping. Such pen or structure shall have secure sides and a secure top tq prevent the dog from escaping over, under, or through the structure and shall also provide protec- tion from the elements. (6) "Animal control officer" means any individual employed, contracted with, or appointed by the anjrnal con- trol authority for the purpose of aiding in the enforcement of this act or any other law or ordinance relating to the licensure of animals, control of animals, or. seizure and impoundment of animals and includes any state or local law enforcement officer or other employee whose duties in whole or in part include assignments that in- volve the seizure and impoundment of any animal. (7) "Owner" means any person, firm, corporation, or organization possessing, harboring, keeping, or having control or custody of an animal or, if the animal is owned by a person under the age of 18, that person's parent or guardian. That, Mr. Cameron Moxley, Maggie's owner stated to me tbat he was walking Maggie on Ketch Drive the morning of October 19, 2010, when a rottweiIler, large breed mix dog, took Maggie in his mouth and pumed her to the ground. 4. Mr. Cameron Moxley stated that another smaller female dog approached the situation .~ while the rottweiller had Maggie in his mouth and pinned. While Mr. Moxley tried to keep the other smaller female dog away, the large male rottweiller dog appeared to bite Maggie again. 5. That after examination of Maggie, the wounds are consistent with a lm'ge giant breed dog ,bite once through the chest and a second time through the abdomen. 6. 11mt there is no evidence of two different type of dog bites nor did Mr. Moxley state that Maggie was bitt~n by two (2) dogs. To Whom it may concern: I have been a frequent visitor to Veronica McCullion's home for many years. Somewhere in the past, I met Junior when he was a friend's outdoor dog living in Naples. When I learned that she was caring for Junior temporarily for this friend and then needing to keep him full time, I was curious to see how this large dog was going to be functioning in her not-very-Iarge home. On my next visit, I was amazed to see what a gentle dog Junior was, given his size. An older dog, he seems to lay around a lot and only barks when the other dog in the house starts. I actually fell in love with Junior with his big amber eyes and calm disposition. I do not own a dog and while I value and respect all animals, I would not be considered the typical "animal lover. " , .-..., It is unbelievable to me that Junior could ever be called a "dangerous dog." While I know that situations can trigger instinctive reactions in dogs - as in humans - it is hard to imagine that the dog I have lived with for weeks at a time would ever attack another animal unless there was some provoking event. I suspect that his sheer size is intimidating to some but when will we learn that we can't truly judge any person or other living creatures by their appearance. Veronica volunteers her time and service to this rescue having become what we fondly call a "Guardian Angel" for our dogs, especially a rescue named Queenie. (Queenie came to us having escaped euthanasia at a shelter many months ago. She was very detached from people and uncomfortable with other dogs. This dog needed a lot of socializing to become adoptable.) Veronica has taken this dog to a level we never thought possible. With her love, patience and dedication, Queenie now responds to people in a positive loving manner. She has become a well socialized adoptable dog. ,..-... I have found the same with Veronica's own dogs. They are well mannered and her Allison is very well socialized. I understand that Allison performs therapy work as a grief counselor along with Veronica. This requires a dog to be exposed to strange dogs and people in various situations without any aggression issues. My experience with dogs not only comes from being a dog owner but more so from being involved in rescue work. I experience every type of behavior from submissive to aggressive in the dogs we rescue. A good pet owner MUST be able to read and communicate with their dogs because all dogs can be dangerous! I have seen that Veronica has excellent communication skills. As a responsible pet owner she knows the right things to do and how to handle any type of dog. I see the love and obedience these dogs have for her. She knows her dogs' temperaments and would never willfully put her dogs in a compromising situation for them or any other dog or person. ".-...., It is a tragedy that the lawn service left Veronica's side gate open when they left, allowing Junior and Allie to leave their fenced back yard the next morning when she let them out. The front gate isn't visible from inside the house and she had repeatedly reminded the lawn workers to close it when finished, in order to keep her dogs safe from getting lost or hit by cars. To my knowledge, there has never been an incident with either of these two dogs in terms of threatening or harming people or animals until the recent death of the neighbor's small terrier. They were removing the litter from the ground into the roll off waiting for the dumpsters to arrive. Then when the dumpsters arrive they will remove the litter from the roll off into the dumpster. Phillips made contact with Joe E, from WMI, who stated he was unaware of any dumpsters being delivered to Tuscany Isles but he will verify and call Phillips back. Customer also stated that the part for the compactor would not arrive until Monday and not be fixed until Tuesday, December 8,2010. Customer was aware that trash was not suppose to be placed in roll off, was putting it there for a temporary storage. Phillips informed customer they will still have a notice to appear and they could bring in their evidence showing that dumpsters were ordered and delivered today and that contractor invoice showing that compactor was broken down and timeline of repair. JOe E called back from Waste Management stating that nothing shows up in their computer system shows no order for dumpster(s) to be delivered to Tuscany Isle at this time. Ther other work order came in on the 29th of November after she had left office and was off on the 30th of November, and responded today. As Addison was leaving the office he observed a repair truck at the compactor. Addison approached the service man and asked if he was there to repair. Addison was told that part had been ordered on 12/2/201 overnite express and he was there to install. Phillips had also observed two sewer cap clean out caps, that were broken and or missing, Phillips had James come out of the office and showed him the sewer cap clean out and informed him that they could not be broken or missing and that no direct or indirect water was allowed to enter into them. Phillips explained to him that the clean out caps in the condition that serveral of them are currently in (broken) that it was also another violation of a county ordinance, Phillips educated him on ordinance and informed him to fix and repair the clean out caps on the property, James is the Regional maintanence man supervisor. His name was Scott and he further stated there is suppose to be a new maint. crew coming in.
