AN ORDINANCE CREATING THE TII~)ERCREEK, PHASE ! STREET
LIGtffI.NG HUNICIPAL SERVICE TAXING DISTRICT; PROVIDING
THE BOUNDARIES OF THE DISTRICT~ DESIGNATING TIlE GOVERNING
BOOY OF THE DISTRICTI AUTHORIZING A TAX LEVY AS PROVIDED
BY LAN; PROVIDING FOR COIISTRUCTIOH AND AN EFFECTIVE DATE
BE IT ORDAI. NED BY THE BOARD OF COUNTY COII4ISSIONERS OF COLLIER COUNTY, FLORIDA;
SECTION ONE: Pursuant to Chapter 125 of the Florida Statutes, the Ttmbercreek,
Phase I Street Lighting Municipal Service Taxing District is hereby created for the
purpose of providing street lighting to the residents of the area hereinafter described:
All that land located ti Collier County,. Florida, and specifically described as:
From Point "A", located on the northerly right-of-way boundary of Augusta
Boulevard, Torrey Pines as recorded in Plat Book 12, Page 32 of the Public
Records of Collier County, Florida, run along said Northerly boundary, 310.83
feet along the arc of a curve, concave to the Northwest, having a radius of
435.00 feet, a chord of 304.26 feet, bearing N 38v38'50'' E to a point of
reverse curvature; thence 953.43 feet along the arc of a curve, concave to the
Southeast, having a radius of 695.00 feet, a chord of 880.61 feet, bearing
N 57~25'15'' E to a point on a curvet thence 81.04 feet along the arc of a
curve, concave to the So)~thwest, having a radius of 300.00 feet, a chord of
80.79 feet, bearing S 00~53'13" E to Point "B", the Point of Beginning .(POB).
From said Point of Beginning run S 82o37°52" E for 15.65 feet to the P.C. of

SECTION l~O: The governing body ot' the Di~tr(ct shall bi ex-officio the Board of
cowry Cm~ntssioners of Collter County, Florida. ,,.
SECrloN ll{REE: The Di~trtct is formed for the purpose of providing street ltghting in
the above described subdivision and to.that end shall possess all the powers to do all.
things reasonably necessary to provide such services) including ownership or rental
property, poles, wires, conduits, lights, maters, and .the power to maintain the same and
'to enter into contracts for providing the same and the electric current to operate any
ltghttng system therein installed.
SECTION FOUR: For the purpose, of car~-ying into effect this Ordinance, the Board
County Comtsstoners shall annually, at the time' required by general budgetary law, make
an ttmized estimate of the amount of money required to carry out the bustness of the
'District for the next fiscal year, which shall be from October 1 to and including September-.?t!
30 following. The estimate shall have for what purpose the monies are required and the
mmount necessary to be raised by taxation within the District. At the time and place ,
for fixing the annual rate of taxation for county purposes, the Board shall fix. and cause '~
to be levied on all property within the District subject to taxation a millage sufficient'
to meet the requirements of the estimate; provided, however, the total millage'shall not '
exceed the millage authorized by law for municipal service taxing or benefit units.
SECTION FIVE: Taxes herein provided for shall 'be assessed and collecte'd in the same
manner and form as provided for the assessment and collection of general county taxes
and subject to the same fees for assessing and collecting as general county taxes.
SECTION SIX: This Ordinance shall be liberally construed to effectuate its public purpose.
If any portion, phrase or word ot' this Ordinance ts'held invalid or unconstitutional,
the remaining parts shall not be affected.. .,-.i
SECTION SEVEN: Effective date of this Ordinance shall beceme effective as provided by
Law. "
