AN ORDINANCE AMENDING ORDINANCE NO. 80-~?, SECTION ONE~
PARTS 3, 4, 5 and 6 TO PROVIDE T~TAT THE TIIRING OR FIRING
OF CERTAIN COUNTY PERSONNEL SIIALL T]~ APPROVED BY TT{E
BOARD OF COUNTY COMMISSIONERS; SHORTENING THE PROCEDURE
TO DISMISS OR DISCIPLINE TIlE COUNTY MANAGER; PROVIDING
SEVERABILITY AND EFFECTIVE DATE.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that
SECTION A. SECTION ONE, Subpart K, is hereby amended to read as

vacancies, positions or employment under the

SECTION B. SECTION ONE, Subp~rt 3~ is hereby amended to read as
follows:
3. No County Co~issioner shall direct or request the
appointment of any person to, or hi~ removal from, office
the County Manager or by any of his subordinates, or In any
manner take part ~n the appointment or removal of officers or
employees in the. administrative services of the County except
as provided in this Ordinance. The Board of County
Co~issioners and its members shall deal with the
administrative services solely through the County Manager,
and neither the Board nor any member thereof shall interfere
in the performance of the duties of any subordinate of the
County Manager, either publicly or privately, except for the
purposes of inquiry and information.

SECTION C. SECTION ON~, Subpart 5, is hereby.amended aa followa~
5. The County Manager may be dismissed or disciplined only
through a resolution imposing such dismissal or discipline
adopted by an affirmative vote of 3/5 of the.entire
membership'of the Board.

SECTION TWO is hereby repealed in its entirety.
Severab]lity
In the event this Ordinance conflicts with any other
ordin;~nce of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion. ~
SECTION G. Effective Date.
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
