Section A~ Sectionb One, Two, and Three of Ordinance No.

Section One: The Board hereby finds that it is
nucessary to establish and impose a fee~ for the use of the
solid waste transfer stations and other landfill
facilities to be charged to commercial haulers and all other
users as herein defined who deposit solid waste as herein
aef~ned at these s~a~*eRs facilities.
Section Twos There is hereby established a fee for
the use of the County's Solid Waste Transfer Station~ by
commercial haulers of $1.00 per cubic yard, with a minimum of
$3.00 per vehicle per dumping. Henceforth{ the s~ecific fees
for the utilization of the Transfer Stations and the Landfill
facilities by commercial haulers and all other users ,e~all
established by Resolution of the Board of County
Section Three: Definitions (A) As Used in
Ordinance, "commercial haulers" shall be defined as a~y
firm, corporation or other entity which engages in
more of the following activities:
The transport and disposal of waste materials of
another where a fee direct or indirect is charged for
such service. ,

The transport of waste materials which originate from
a commercial establishment. This shall include the
transportation of waste materials by any owner,
proprietor, agent, or employee of any commercial
establishment who transports such materials for or on
behalf of such commercial establishment.
The performance of any service, trade or work in the
course of which waste materials are generated and
which are transported as part of the service, trade,
or work performed. Examples of this include, but are
not limited to, such activities as lawn maintenance
and landscaping, or construction activities.
(B) U~crs: Any per~on~ firm~ corpor~tion~ or other
entity~ public or private~ residing in or maintaininQ business
headquarters in Collier County and who deposits solid wast~ at
the County's Solid Waste facil'ities. ,
(C) Transfer Stations: Any manned C~unty owhed and
operated facility which receives solid waste from users in
Order to transport said solid waste into County Landfill sites
~or disposal. A transfer station may be located at the en-
trance to a landfill site.
(P) Landfill Sites: Any County owned and operated
facility for the disposal of solid waste.
'fE) Franchise Hauler: Any commercial entity which
enjoys the'~xclusive right through franchise agreement"with
Collier County for the removal~ collection and disposa"~ of
solid waste.
(F) Solid Waste: "Solid waste" means garbage~
rubbish{ refuse, and other discarded solid or semisolid mate-.
rials resulting from domestic, industrial, commercial, agricul-
tural, and governmental operations{ but does not include solids
or dissolved material in dome~tlc sewage or other significant
~ollutants in water resources such as silt~ dissolved or
.~uspended solids in industrial wastewater effluents, dissolved
materials in irrigation return flows{ or Other common water
~911utants.
(G) Landfill Fee: Fee to be assessed at the County's
landfill sites based on the amount of solid waste to be dis-
posed..
(H) Transfer Station Fee: Fee to be assessed at the
transfer station sites based on the amount of solid waste to be
transported into the landfill sites.
(I) Residential Disposal Fee: A fee collected by
franchise haulers from regulated residential customers based on
an estimated average tonnage of solid waste per residential
customer to be disposed of at the landfill sites.
(J) Residential Customer~ As defined in the franchise
agreements~ any residential customer of the franchise hauler
for billing purposes.
Section B: The following section is added to Ordinance
No. 82-14:
Franchise haulers, in lie~ of paying the landfill fee for
their residential customers whose rates are regulated by
~ollier County{ shall charge each such regulated customer
on behalf of Collier County a residential-disposal fee ~er
residential customer. This residential disposal fee shall
. be paid quarterly at the time of the ~ayment of their
franchise fee. The franchise h~61ers shall submit a
¢. report on all such collections at the"time of payment to
· ,~. ~he 'County. The amount of the residential disposal fee
for regulated customers shall be established by Resolution
of'the Board of County Commissioners.
Section C~ This ordinance shall take effect as provided by
