AN ORDINANCE AMENDING ORDINANCE 82-2, THE
COMPREHENSIVE ZONING REGULATIONS FOR THE
UNINCORPORATED AREA OF COLLIER COUNTY BY
AMENDING THE ZONING ATLAS MAP NUMBER 50-
26-5 BY CHANGING THE ZONING CLASSIFICATION
OF THE HEREIN DESCRIBED PROPERTY FROM "A-2"
AGRICULTURE TO "PUD" PLANNED UNIT DEVELOP-
MENT FOR THE PROPERTY KNOWN AS THE AMERICAN
LUTHERAN CHURCH: PART OF SECTION 16, TOWN-
SHIP 50, RANGE 26; AND BY PROVIDING AN EFF-
ECTIVE DATE.
WHEREAS, Bruns & Bruns, Inc. petitioned the Board of
County Commissioners to change the Zoning Classification of
the herein described real property;
NOW, THEREFORE BE IT ORDAINED by the Board of Co~ty
Commissioners of Collier County, Florida:
SECTION ONE:
The Zoning Classification of the hereih described_~eal c~
property located in Section 16, Township 50, Range 26, Collier
County, Florida is changed from A-2 to PUD - Planned Unit
Development in accordance with the PUD Document attached hereto
as Exhibit "A" which is incorporated herein and by reference
made a part hereof. The Official Zoning Atlas Map Number 50-26-
5, as described in Ordinance 82-2, is hereby amended accordingly.
SECTION TWO:
This Ordinance -hall become effective upon receipt of
notice that is has been filed with the Secretary of State.

1.1 LOCATION
The project site, measuring 6.62 acres, is situated immediately
north of Rattlesnake Hammock Road and east of Polly Avenue.
1.2 PRESENT ~ONING
The current zoning is Agricultural though no use is presently
being made of the subject property. The County's Compre-
hensive Plan designates the site for residential use of up
to four (4) units per acre.
1.3 GENERAL DEVELOPMENT OBJECTIVES
High quality, moderately priced single family homes and
condominium apartments with a maximum density of four (4)
units/acrQ (6.62 x 4 - 26 units) and aesthetic ~u~lity
environment are the objectives for this develcpment.
1.4 EXISTING UTILITIES
Existing County owned potable water supply will serve this
development. Existing Lely sewage disposal and treatment
plant is close enough to this development site for use
thru a force-main and lift station system.

The development of 6.6 acres of the subject property in
Section 16, Township 50 South, Range 26 East, Colli~ County,
Florida, as a Planned Unit Development (PUD), is in compli-
ance with the planning and development objectives set forth
in the Collier County Comprehensive Plan. Additionally, this
PUD complies ~ith all applicable state and local codes and
regulations.

PURPOSE
The purpose of this Section is to set forth the regulations
for the development of single-family Tract "A" of this
Planned Unit Duvelopment.
3.2 PERMITTED USES AND STRUCTURES
No building or structure, or part thereof, shall be erected,
altered, or used, or land or water used, in whole or in part,
for other than the following=
A. Permitted Principal Uses and Structures
Public parks, public playgrounds, public
playfields, and commonly owned o~un space.
B. Permitted Accessory Uses and Structures
(1) Customary'accessory uses and structures,
including private gurages.
(11) Signs as permitted for Single family resi~
dential distracts by the zoning ordinance
in effect at the time of application for

the promotion of a residential development.

ential Tract "B# of this Planned Unit Development.

No building or structure, or part thereof, shall be erected,
altered, or used, or land or water used, in whole or in
part, for other than the following:
A. Permitted Principle Uses and Structures
(1) Multi-unit dwellings
B. Permitted Accessory Uses and Structures
(1) Customary accessory uses and structures
(11) Signs as permitted for multi-family zoning.

WATER SUPPLY
Potable water shall be supplied by the ew/sting co11~ty-

SANITARY SEWAGE DISPOSAL
The project area sewage will be collected and ~%u~ped by a
life station, through a force-main, into the Lely sewage dis-
posa% and treatment plant.
MAINTENANCE OF COMMON OPEN SPACE
The developer will provide for and establish an organization
for any condominium whe~ any part is developed as a condo-
minium for the maintenance of common open spaces/recreational
facilities, including but not limited to, al~ interior streets
and off-street parking areas.
DRAINAGE
Drainage design standards shall comply with all applicable
state and local codes and regulations.
FIRE - PREVENTION
This development shall comply with all applicable fire-
prevention codes and regulations.
DEVELOPMENT PLAN
A. It is the developer's intention to develop this project
in two phases:
(1) The Tract 'A' containing fourteen (14) single-
ramify %ors on 4.14 acres will be developed
,phase 1.
(11) The multi-family Tract #B' containing
