AMENDMENT TO AGREEMENT
THIS AMENDMENT TO AGREEMENT entered into this ~ l, ol- day of
~ ' 2010, by and between GARY E. VERDER, II and BRANDI S.
VERDER, husband and wife (hereinafter referred to as "Seller"), and COLLIER
COUNTY, a political subdivision of the State of Florida, its successors and assigns,
(hereinafter referred to as "County").
WITNESSETH
WHEREAS, County and Seller have previously entered into an Agreement dated May
11, 2010 (the "Agreement"); and
WHEREAS, pursuant to the terms of Paragraph 4A of the Agreement, Seller was
allowed extended possession of the subject property for a period of two (2) months with
no extensions of the term; and
WHEREAS, Seller's circumstances have changed and Seller is desirous of having
extended possession of the subject property an additional nine (9) month period; and
WHEREAS, County and Seller are desirous of amending said Agreement to reflect said
change to the extended possession period.
NOW THEREFORE, in consideration of the covenants and agreements provided within
the said Agreement dated May 11, 2010 and Ten Dollars ($10.00) and other good and
valuable consideration, the said Agreement is hereby amended as follows:
1. Paragraph 4.A. is deleted in its entirety and replaced with:
"Seller may occupy the Property after Closing until May 9, 2011 (the "Initial
Term"). In the event Seller and County agree to extend the Initial Term of
extended possession by an additional number of months (the "Extended
Term"), an additional sum will be required from Seller and shall be calculated
by multiplying the number of months of the Extended Term by $2000.00. This
Fee must be paid to the County in a lump sum, no later than thirty (30) days
before expiration of the Initial Term, whereupon County and Seller shall
execute an addendum to this Agreement memorializing this Extended Term of
possession. "
2. All other terms and conditions of said Agreement between County and Seller
remain unchanged and are in full force and effect except as expressly
provided herein to the contrary.
IN WITNESS WHEREOF, Seller and County have hereto executed this Amendment to
Agreement the day and year first above written.
