AN ORDINANCE AMENDING ORDINANCE 77-18, THE PELICAN BAY
PLANNED UNIT DEVELOPMENT DOCUMENT, BY AMENDING THE PRESENT
EXHIBIT "C" (SITE PLAN) TO REFLECT THAT THE MAIN ROAD
{ROADWAY "D" OF EXHIBIT "J" OF THE PELICAN BAY PUD) T~OUGH
THAT AREA OF THE PUD BOUNDED 8Y PELICAN BAY BOULEVARD
(ROADWAY "A" OF EXHIBIT "J" OF THE PELICAN BAY PUD) ON THE
NORTH, U.S. 41 ON THE EAST, THE NORTH BOUNDARY OF THE
PELICAN BAY UNIT FIVE PLAT ON THE SOUTH, AND THE CLUB AT
PELICAN BAY GOLF COURSE ON THE WEST IS INTENDED TO BE
PRIVATE; AND BY PROVIDING AN EFFECTIVE DATE.
WHEREAS, Petitioner, Westinghouse Communities of Naples, Inc. (fomerly
known as Coral Ridge-Collier Properties, Inc,), has petitioned the Board of
County Commissioners of Collier County to amend Exhibit "C" (Site Plan) to
Ordinance 77-18 to reflect that the main road (Roadway "D" of Exhibit "j" of
the Pelican Bay PUD) through that portion of the Pelican Bay community which
is bounded on the north by Pelican Bay Boulevard (Roadway "A" of Exhibit "j"
of the Pelican Bay PUD), on the east by U.S. 41, on the south by the north
boundary of the Pelican Bay Unit Five Plat, and on the west by THE CLUB at
Pelican Bay Golf Course is intended to be a private roadway; and
WHEREAS, the Coastal Area Planning Commission and the County staff have
reviewed Petitioner's request and recommend approval; and
WHEREAS, that portion of the road which is the subject of this amendment
has never been dedicated to the public; and
WHEREAS, adoption of this Ordinance will not result in a substantial
deviation from the Development Order for Pelican Bay adopted by the Board of
County Commissioners of Collier County pursuant to Chapter 380, Florida
Statutes;
NOW THEREFORE BE IT ORDAINED by the Board of County Commissioners of Collier
County, Florida:
SECTION ONE
The present Exhibit "C" (Site Plan) to Ordinance 77-18 is hereby amended
to reflect that the main road (Roadway "D" of Exhibit "j" of the Pelican Bay
PUD) through that portion of the Pelican Bay community which is bounded as
follows:
North - Pelican Bay Boulevard (Roadway "A" of Exhibit "j" of the Pelican Bay PUD),
East - U.S. 41,
South - The north boundary of the Pelican Bay Unit Five plat,
West - THE CLUB at Pelican 8ay Golf Course,
is intended to be a private roadway.
SECTION TWO
This ordinance shall become effective upon receipt of notice that it has
been filed with the Secretary of State.
