UNIT DEVELOPMENT FOR HERON LAKE LOCATED NORTH
OF 1-75 SOUTH OF GOLDEN GATE CITY, EAST OF SANTA
BARBARA BOULEVARD AND PROVIDING AN EFFECTIVE DATE:
I~IEREAS, William R. Vines, representing Thomas Merryweather,
petitioned the Board of County Commissioners to
change the Zoning Classification of the herein described real
property;
NOW, THEREFORE BE IT ORDAINED by the Board of County Commissioners
of Collier County, Florida:
SECTION ONE:
The Zoning Classification of the herein described real property
located in Section 33, Township 49 South, Range 26 East, Collier County,
Florida is changed from A-2 to "PUD" Planned Unit Development in accordance
with the PUD document attached hereto as Exhibit "A" which is
incorporated herein and by reference made part hereof. The Official
Zoning Atlas Map Number, Number 49-26-8 as described in Ordinance 82-2,
is hereby amended accordingly.

SECTION T~O:
This Ordinance shall become effective upon receipt of notice
that is has been filed with the Secretary of State.

DISTRICT ZONE: PUD.
PERMITTED USES:
Single family dwellings; multi-family dwellings; recreational open
space lands, structures and facilities; docks; temporary sewage
treatment and disposal facilities.
PERMITTED ACCESSORY USES AND STRUCTURES:
Accessory uses and structures which are customary in residential
communities and in recreational open space areas; administrative
sales and rental offices, which offices may be located in temporary
or permanent structures and may be located within a residential
or recreational structure.
MAXIMUM GROSS PROJECT DENSITY:
5.68 dwelling units per acre. Total dwelling unit count shall not exceed
577.
DEVELOPMENT STANDARDS:
MULTI-FAMILY SITES
Mlnlmum building setback from a site boundary: 30'
Minimum separation between adjoining buildings: 1/2 the sum of
the heights.
Maximum building height: 3 stories.
Minimum dwelling unit floor area: efficiency- 500 sq,ft.; 1 bedroom-
600 sq. ft.; 2 bedroom- 750 sq.ft.; 3 bedroom- 900 sq. ft.

to county standards with respect to length and structural

MULTI-FAMILY DWELLING UNIT DISTRIBUTION:
Multi-finally dwelling unit distribution shall occur generally as
indicated on the approved Master Plan. With the approval of the
Community Development Administrator, minor changes may be made
in the distribution of multi-family dwelling units among the nine
multi-family sites so long as the total number of multi-family dwelling
units does not exceed 292.

MASTER PLAN:
The approved Heron Lake Master Plan shall also constitute the
approved Subdivision Master Plan.
PARK AND OPEN SPACE:
Park and open space areas indicated on the Master Plan may be
utilized for natural area recreation purposes and may be improved
with various recreation facilities. No po~'tion of the recreational
open space indicated on the Master Plan may be utilized for residen-
tial building purposes. No development within or alterations of the
Oak Hammock Preserve which would affect the integrity of the
preserve shall be allowed.
EXCEPTIONS TO COUNTY SUBDIVISION RECULATIONS:
Article X, Section 16: Sidewalks need not be constructed within
street right of way but shall be constructed as indicated on
the approved Master Plan.
Article XI, Section 10: The requirement that Permanent Reference
Monuments be installed in typical water valve covers shall be
waived.
Article XI, Section 19: Street name signs shall be approved by the
County Engineer but need not meet the U.S.D.O.T.F.H.W.A.
Manual of Uniform Traffic Control Devices. Street pavement
painting, striping, and reflective edging requirements shall be
waived o

TRAFFIC:
1. The developer shall reserve a right-of-way to allow a future
roadway connection eastward from the project. The purpose
of this connection Is to ultimately connect Santa Barbara
Boulevard with CR-951.
2. The developer shall cooperate with Berkshire Lakes and provide
a falr share contribution toward the capital costs of appropriate
turn lanes, traffic signalization and arterial level street lighting
at the project entrance on Santa Barbara Boulevard.
The developer shall connect the proposed bike path to the project's
entranceway and to the reserved right-of-waY on the east.
