CEB Liens 09/2010 CODE ENFORCEMENT BOARD COLLIER COUNTY, FLORIDA BOARD OF COUNTY COMMISSIONERS, COLLIER COUNTY, FLORIDA, Petitioner, CESD200900 18220 vs. EDWARD M. JR. AND TAMMY HARRIS, Respondents ORDER IMPOSING FINE/LIEN THIS CAUSE came on for public hearing before the Board on March 25, 2010, after due notice to Respondents at which time the Board heard testimony under oath, received evidence, and issued its Findings of Fact and Conclusions of Law and thereupon issued its oral Order which was reduced to writing nunc pro tunc on April 27,2010 and furnished to Respondents and was recorded in the Public Records of Collier County, Florida at OR 4563, PG 1876, et. seq. on May 6, 2010. An Affidavit of Non-Compliance has been filed with the Board by the Code Enforcement Official on September 22, 20 I 0, which Affidavit certified under oath that the required corrective action has not been taken a~ ordered. Accordingly, it having been brought to the Board's attention that Respondents have not complied with the Order dated April 27, 2010, it is hereby ORDERED, that the Respondents, EDWARD M. JR. AND TAMMY HARRIS, pay to Collier County fines in the amount of $24,400 (Order Items I and 3) for the period of May 25, 2010 through September 23, 2010 (122 days), plus fines in the amount of $400 (Order Items 2 and 4) for the period September 22,2010 through September 23,2010 (2 days), and $80.57 for the operational costs incurred, for a total of $24,880.57. IT IS FURTHER ORDERED that the fines and operational costs shall continue to accrue until Respondents come into compliance or until Judgment is rendered in a suit to foreclose on a lien filed pursuant to Section 162.09 Florida Statutes. Any aggrieved party may appeal a final order of the Board to the Circuit Court within thirty (30) days of the execution of the Order appealed. An appeal shall not be a hearing de novo, but shall be limited to appellate review of the record created within.
