NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS
OF COLI. IER COUNTY, FLORIDA:
The Collier County Building Code, Chapter 7, Article I, of the
Collier County Code of Laws and Ordinances, is hereby amended as follows:
SECTION ONE
The "Standard Mechanical Code, 1982 Edition," as published by the
Southern Building Code Congress International, Inc., and as amended
herein, is adopted by reference as the "Collier County Mechanical Code" to
protect the health, welfare, safety, common interest and convenience of
the citizens, visitors, and residents of Collier County, Florida.
SECTION TWO
The "Standard Mechanical Code, 1982 Edition," is hereby amended to
read as follows:

CHAPTER I - ADMINISTRATION
104.1 - WHEN REQUIRED
Amend section to read as follows:
A person, firm, or corporation shall not do or cause to be
done, any installations, alterations, repairs, or replacement
of equipment or systems covered by the provisions of this code,
without first having obtained the proper permit from the
Mechanical Official. Ordinary minor repairs may be made
without a permit provided that such repairs shall not violate
any of the provisions of this code.
104.2 - PERHITS NOT REQUIRED
Add subsection (8) and (9) to read as follows:
8. Replacement of components parts of residential air
conditioning systems such as: condensors, evaporators, air
handlers, compressors, controls, etc. units up to and including
five tons.
9. Emergency repairs may be done, subject to notifying
the Mechanical Official as soon as reasonably pratical to deter-
mine permit requirements.
106 - FEES
Amend section to read as follows:
The Board of County Commissioners shall establish, by
Resolution, a schedule of fees and charges for matters per-
taining to this Ordinance and allied matters. It is the intent
of these regulations that the County shall not be required to
bear any part of the cost of applications made under this
Ordinance.
The schedule of fees and charges shall be posted in the
office of the Building Code Compliance Department. The charges
listed may be changed by resolution of tbs Board of County
Commissioners and are not subject to the procedure for ~mend-
ment of this Ordinance set out in Section 110. -'
109 - VIOLATIONS AND PENALTIES
Amend section to read as follows:
If any person, firm, corporation, or other legal entity
whether public or private, shall fail or refuse to obey or
comply with, or violatss, any of the provisions of this
Ordinance, such person, firm, corporation, or other legal
entity whether public or private, upon conviction of such
offense, shall be punished by a fine not to exceed Five Hundred
Dollars ($500.00) or by imprisonment not to exceed sixty (60)
days in the county Jail, or both, in the discretion of the
court. Each day of continued violation or non-compliance shall
be considered as a separate offense. In addition, any person,
fir~, corporation, or other legal entity whether public or
private, convicted under the provisions of this section shall
pay all costs and expenses involved in the case.
Nothtn8 herein contained shall prevent the County from
taking such other lawful action in any court of competent _
Jurisdiction aa ts necessary to prevent or remedy any viola-
tion. Such other lawful action shall include, but shall not be
limited to, an equitable action for injunctive relief and an
action at law for damages.
110 - APPEALS
Amend section to read as follows:
~;henever the Hechanical Official shall reject or refuse
mode or manner of construction proposed to be followed or mater-
ials to be used in the erection or alteration of a building or
structure, or when it is claimed that the provisions of this
code do not apply, or that an equally good or more desirable
form of construction can be employed in any specific case, or
when it is claimed that the true intent and meaning of this
code or any of the regulations thereunder have been misconstrued
or wron$1y interpreted, the owner of such building or structure
or his duly authorized agent, may appeal from the decision of
the Mechanical Official to the Board of Adjustments and Appeals,
pursuant to the procedures as met forth in the Collier County
Ordinance establishing the Board of Adjustments and Appeals.

CIIAPTER II - DEFINITIONS
201 - CENEILAL
Amend Section by adding tbs following definitions:
Mechanical Official - Tbs Mechanical Official is the
Building Code Compliance Director, or bis designee.
OWNER - Any person, agent, firm, or corporation having a
legal or equitable interest in the property.
CItAPTER III - AIR CONDITIONING, HEATING AND VENTILATION EQUIPMENT
303.3 - ATTIC INSTALLATION
Amend subsection (b) to read as follows:
(b) A permanent electric light outlet with lighting
fixture and receptical controlled by a switch located at the
required passageway opening shall be provided at the heating
or air conditioning unit.
308.9 - CLOTHES DRYERS
Add subsection (d) to read as follows:
(d) Clothes dryers shall be exhaust vented through a
vertical wall in all one, two, or three-story buildings. The
total developed length of any clothes dryer exhaust shall be
either limited to a vertical height of ten (10) feet and a
total length not to exceed twenty (20) feet or built in accord-
ance with manufacturers recommendations. The total number
of 90° elbows in any clothes dryer exhaust system shall not
exceed two in number. All dryer exaust system to be minimum of
4" in diameter. In all buildings exceeding three stories in
height, clothes dryer exhaust systems must be submitted by a
registered Professional Engineer or Architect with his impressed
seal for approval of the Mechanical Official.
CHAPTER IV - REFRIGERATION
404 - INSTALLATION REQUIREFiENTS
Amend subsection (a) to read as follows:
(a) Foundations and supports for condensing units or
compressor units shall be of substantial construction suffi-
cient to support tbs load. When used, wood exposed to tbs
weather shall be pressure treated or approved wood of natural
resistance to decay in accordance with the Collier County Building
Code. All condensing units mounted on a roof or any other
location subject to movement by winds or other forces must be
tied down as required by the Hechanical Official.
CttAPTER V - DUCTS AND DUCT SYSTEHS
504 - DUCT CONSTRUCTION AND INSTALLATION
Add subsection (k) to read as follows:
(k) Fiberglass duct board systems shall be constructed
of materials meeting ULIgl Class 1 duct construction require-
ments and shall be installed in accordance with SMACNA fibrous
glass duct construction standards. The closure system having
an approved listing with the particular fibrous glass duct
product must be used in accordance with the listing and the
recommendations of the board manufacturer.
505 - FLEXIBLE AIR DUCT CONNECTORS
Add subsection (e) to read as follows:
(e) All Flexible ducts shall meet UL181 Class 1 duct
specifications and shall be so labeled. All horizontal runs of
flexible ducts shall be supported a minimum o£ every three (3)
feet. All vertical runs of flexible ducts shall be supported a
minimum of every six (6) £eet. All connections of flexible
ducts plenums, trunks, systems or mixing boxes, etc., shall
use a mechanical connector and shall be air tight. When Class
I flexible ducts are installed in accordance with the above
specifications there shall be no length limitation.
508 - DUCT CLEARANCES
Add subsection (c) to read as follows:
(c) All supply and return plenum chambers shall have a
minimum clearance of 6" on all sides of unit for accessibility
of duct Joints.
CHAPTER VI - PIPING
603 - CONDENSATE DRAIN PIPING
Add subsection 603.5 to read as follows:
603.5 - INSULATION
Ail condensate lines, except emergency pan drains, shall
have a trap in line. Line must be insulated to prevent conden-
sation. Schedule eighty (80) PVC pipe may be used without
insulation.

SECTION TIIREE: REPEAL OF PREVIOUS ORDINANCE
Ordinance No. 81-72 ia hereby repealed as of the effective date of
this ordinance,
SECTION FOUR: CONFLICT AND SEVERANCE
In the event this ordinanes conflicts with shy other ordinance of
Collier County or other applicable law, the more restrictive shall apply.
If any phrase or portion of this ordinance ia held invalid or unconsti-
tutional by any court of competent Jurisdiction, such portion shall be
deemed a separa'te, distinct, and independent provision and such holding
shall not affect the validity of the remaining portion.
SECTION FIVE: EFFECTIVE DATE
This Ordinance shall become effective upon notice that it has bean
received by the Office of the Secretary of State.
