The Collier County Building Code, Chapter 7, Article I, of the
Collier County Code of Laws and Ordinances~ is hereby amended to include
and establish the Collier County Swimming Pool Code as follows:
SECTION ONE
The "Standard Swimming Pool (;ode, 1982 Edition," as published by the
Southern Butld~ng Code Congress International, Inc., and as amended
herein, is adopted by reference as the "Collier County Swimming Pool
Code" to protect the health, welfare, safety, common interest, and
convenience of the citizens, visitors, and residents of Collier County,
Florida.
SECTION TWO
The "Standard Swimming Pool Code, 1982 Edition," is hereby amended
to read as follows:
CHAPTER I - ADMINISTRATION
105.3 - APPLICATION FOR PERMIT
Amend section to read as follows:
Any person who desires to install, or structurally alter,
a swimming pool shall be required to make application and
obtain a permit, lie shall describe 'the work to be done and the

location, o~nership, occupancy, and uee of the premises in
connection there-with, The Administrative Authority may require
pi.ns, specifications or drawings and such other information ss
he may deem necessary and as prescribed in Section 101.8 of
this Code, If the pool ia a Public pool, the Health Department
and Office of Licensure and Certification also needs notifica-
tion and Plans.
When required by the Building Official, two or more copies
of specifications, and of drawings drawn to scale with suffi-
cient clarlty and detail to indicate the nature and character
of the work, shall accompany every application. Such drawings
and specifications shall contain information, in the form of
notes or otherwise, as to the quality of materials, where
quality is essential to conformity with this code. Such
information shall be specific, and this code shall not be cited
as a whole or in part, nor shall the term "legal" or its
equivalent be used, as a substitute for specific information.
Such information shall include:
(a) Plot plans with dimensions and drawn to scale and
showing at least tile following:
1. Property lines, easements, rights-of-way of
record and overhead utilities sdJacent to pool area
or over the property.
2. Existing structures, fencing, retaining walls,
and other relevant characteristics adjacent to pool
a rea.
3. The proposed pool shape, dimensioned and located
to show setbacks, side yards, and clearance from
existing structures adjacent to pool area.
4. Tile proposed mechanical equipment pad, dimen-
sions and location.
5. All deck equipment items, slides, diving boards,
etc.if included.
6. The proposed deckwork configuration, showing its
anticipated drainage with arrows.

(b) Structural plan showing at least the following:
1. The type of construction, whether gunite, shot-
crete, poured concrete, pre-fabricated, or other.
2. The pool dimensions, including the depth, snd
adequate cross-sections drawn to scale.
3. Plans, including the reinforcing steel schedule
and detailed drawing.
4. A statement by the applicant concerning the
anticipated nature of the soil under and around the
pool structure.
5. The interior finish details, marcite, fiber-
gla~s, tile, etc.
(c) A mechanical plan showing at least the following:
1. A volume, system flow sized for a minimum of 3
turnovers per 24 hours for private pools. A volume
system flow sized for a minimum of 4 turnovers per 24
hours for public pools.
2. Tbs type and size of filteration systems and
waste disposal.
3. The type and size of pool heater, all piping to
be minimum ] 1/2", schedule 40 PVC or approved
equivalent.
~. The rated capacity of the pool equipment, Heaters
in g~; or BTU, Pumps in II.P. or Amperage Draw at the
design head with the size and type of motor indicated
and identified as self-priming or straight centrif-
ugal, size of present service.
5. The means of adding makeup water shall be protected
with a means of backflow prevention.
105.4 - COST OF PE~IIT
Amend section to read as follows:
Tbs Board of County Commissioners shall establish, by
Resolution, a schedule of fees and charges for matters per-
taining to this Ordinance and allied matters. It is the intent
of these regulations that the County shall not be required to
bear any part of the cost of applications made under this
Ordinance.

The schedule of fees and charges shall be posted in the
office of the Building Code Compliance Department. The charges
listed may be changed by resolution of the Board of County
Commissioners and are not subject to the procedures of the
Board of Adjustment and Appeals,
107 - VIOLATIONS AND PENALTIES
Amend section to read as follows:
If any person, firm, corporation, or other legal entity
whether public or private, shall fail or refuse to obey or
comply with, or violates, any of the provisions of this Ordin-
ance, such person, firm, corporation, or other legal entity
whether public or private, upon conviction of such offense,
shall be punished by a fine not to exceed Five Hundred Dollars
($500.00) or by imprisonment not to exceed sixty (60) dsys in
the county Jail, or both, in the discretion of the court. Each
dny of continued violation or non-compliance shall be con-
sidered as a separate offense. In addition, any person, firm,
corporation, or other legal entity whether public or private,
convicted under the provisions of this section shall pay all
costs and expenses involved in the case.
Mothing herein contained shall prevent the County from
taking such other lawful action in any court of competent
jurisdiction as is necessary to prevent or remedy any viola-
tion. Such other lawful action shall include, but shall not be
limited to, an equitable action for injunctive relief and an
action at law fcr damages.

~enever the Building Official ~hall reject or refuse mode
or manner of construction proposed to be followed or materials
to be used in the erection or alteration of a building or
structure, or when it is claimed that the provisions of this
code do not apply, or that an equally good or more desirable
form of construction can be employed in any specific case, or
when it is claimed that the true intent and meaning of this
code or any of the regulations thereunder have been mia-
construed or wrongly interpreted, the owner of such building or
structure or his duly authorized agent, may appeal from the
decision of the Building Official to the Board of Adjustments
and Appeals, pursuant to the procedures as set forth in the
Collier County Ordinance establishing the Board of Adjustments
and Appeals.
CItAPTER II - DEFINITIONS
202 - DEFINITIONS
Amend section by adding the following definitions:
PUBLIC POOI,S - Those serving & or more families in Joint
tenancy.
PRIVATE POOLS - Serving up to and including 3 family
units.
PUBLIC SPAS - Those serving 4 or more families in Joint
tenancy.
PRIVATE SPAS - Serving up to and including 3 family units.
CHAPTER III: MECHANICAL REQUIREMENTS GENERAL - PUBLIC AND

Add subsections (c) and (d) to resd as follows:
(c) Rnckftll shall be compacted to assure minimum settle-
ment of fill.
(d) Upon completion of backfilling and tamping, a final
pressure test shall be made on all piping under a static water
or air pressure test cf not less than thirty-five (35) PSI for
fifteen (15) minutes.
312 - POOL WATER I{EATI}:G EOUIPMENT
Add subsection (e) to read as follows:
(e) All pool heating equipment shall comply with Florida
Energy Code requirements.
3~3 - GAS PIPING
Amend section to read as follows:
Gas piping shall comply with Collier County Gas Code.

CIlAPTER V - PUBLIC POOLS
Amend Chapter V to read as follows:
All public pools shall be subject to rules of the Department of
Ilealth and Rehabilitative Services of the State of Florida under
swimming pools and bathing places, Florida Administrative Code,
Chapter 10D.5.
SECTION THREE: CONFLICT AND SEVERANCE
the event this ordinnnce conflicts with any other ordinance of
Collier County or other applicable law, the more restrictive shall apply.
If any phrase or portion of this ordinance is held invalid or unconsti-
tutional by any court of competent jurisdiction, such portion shall be
deemed a separate, distinct, and independent provision and such holding
shall not affect thc validity of the remaining portion.
SECTION FOUR - EFI-'iX;'I'IVi-; I)ATE
This Ordinance shall become e/.fective upon notice that it has been
