REVOCABLE TEMPORARY LICENSE
. This REVOCABLE TEMPORARY LICENSE entered into this Jl day of
Apr,\ ,2010 by and between COLLIER COUNTY, a political subdivision of the State
of Florida, whose mailing address is 3301 Tamiami Trail East, Naples, FL 34112 (hereinafter
referred to as "County"), and LEE COUNTY ELECTRIC COOPERATIVE, INC., a Florida
non-profit corporation, whose mailing address is Post Office Box 3455, North Fort Myers, FL
33918 (hereinafter referred to as "LCEC"), approving the use of County-owned property for the
purpose of constructing utility facilities.
WHEREAS, LCEC requires the use of County-owned property for the purpose of
constructing, operating, and maintaining utilities, including but not limited to, distribution lines
and other related equipment for fiber optic telecommunications and television purposes, over and
through the property described as follows, to wit;

BY THIS REFERENCE MADE A PART HEREOF
WHEREAS, the COUNTY is willing to approve the use of the Property for such
purposes;
NOW THEREFORE, THE PARTIES AGREE AS FOLLOWS:
1. The COUNTY herein approves, for Ten Dollars ($10.00) and other valuable
considerations, the use of the Property for the purpose of constructing, operating and maintaining
utilities, including but not limited to, distribution lines and other related equipment for fiber optic
telecommunications and television purposes, over and through the property as more particularly
described above, hereinafter referred to as "Property".
2. The approval of the use of the Property by LCEC shall expire upon grant of a permanent
Utility Easement.
3. Upon completion of the construction of the utility facilities on the property, a permanent
Utility Easement will be granted to LCEC for the 16 foot strip of land wherein the utility
facilities are located. The original, signed and sealed sketch and description of the easement area
shall be prepared by a licensed Florida surveyor and will be provided to LCEC at no cost to
LCEC. Upon the completion of construction, LCEC shall restore the surface of the property to
its original condition.
4. This Revocable Temporary License shall be administered on behalf of the COUNTY by
and through the Collier County Real Property Management Section.
5. LCEC, to the extent permitted by law, and as limited by Section 768.28, F.S., shall
indemnity, save, protect and hold harmless COUNTY against any damages and claims arising by
reason of LCEC's utility installations or the operation of same.
IN WITNESS WHEREOF, the parties hereto have made and executed this Revocable
Temporary License as of the day and year first above written.

PLEASE NOTE: It appears that you have already scanned and saved documents 3 and 4
above in our Real Property File under BMR Records in a folder titled "Goodland Boat Park".
Documents 1 and 2 do not appear to have been added anywhere in the Real Property File
under BMR Records and should be added to the same Goodland Boat Park folder. For
informational purposes, Goodland Boat Park is the current name for the County-owned
property previously known as Dolphin Cove, and the Agreement and Deed evidencing the
County's purchase are in a folder called "Dolphin Cove." In addition, the "Good land Water
Main" folder has the water main easement document that reflects the water main installed on
the Goodland Boat Park property. If you think it would provide ease in future searching,
these three folders could be combined into the folder titled "Good land Boat Park."
