SCRIPTION! AUTHORIZING THE LEVY OF AN AD VALOREM TAX
NOT TO EXCEED ONE MILL IN ANY ONE FISCAL YEAR!
PROVIDING FOR A GOVERNING BOARD AND DEFINING ITS
POWERS AND DUTIES~ PROVIDING FOR CONFLICT AND
SEVERABILITY~ PROVIDING AN EFFECTIVE DATE
BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER
COUNTY, FLORIDAt
Section 1: The Collier County Firs Control Munigipal
9axin.~ 'Unit Crssted~ D~scription Of Boundaries.
Pursuant to Chapter 125 of the Florida Statutes, the Collier
Coun.ty Firs dentrol Municipal Services Taxing Unit is hereby created
and established for the purpose of providing fire protection to the
residents of the areas hereafter described~ all of the unincorpora-
ted areas of Collier County, Florida lying outside the boundaries of
an existing fire control taxing di~trict.
Section 22 Ad Valorem Tax Not To Exceed One Mill Authorized.
The Collier County Fire Control Municipal Services Taxing Unit
is hereby empowered and authorized to levy an ad valorem tax not to
exceed one mill in any one fiscal year.
Section 32 Governing Board; Powers And Duties.
The governing board of the Collier County Fire Control Munici-
pal Services Taxing Unit shall be the Board of County Commissioners
of Collier County, Florida. The Board shall possess the power and
duty to conduct the affairs of the unit as prescribed by law, and is
specifically empowered to provide fire protection services within
the area described in Section 1 of this Ordinance on a contractual
basis with various dependent or independent fire control districts,
based on an ability to serve. .~
Section 42 Conflict And Severability. ..
In the event this Ordinance conflicts with any oth,r
of Collier County or other applicable law, the more
shall apply. If any phrase or portion of this Ordinance
invalid or unconstitutional by any court of competent Jurisdiction,
such portion shall be deemed a separate, distinct and independent
provision and such holding shall not affect the validity of the
remaining portion.
Section $~ Effective Date.
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed with
the Secretary of State.
