Section One: Ordinance No. 75-7 is hereby repealed in its entirety.
Section Two: Authority for this Ordinance,
This Ordinance ia adopted pursuant tm Chapter 125, Fla. Stat., Chapter
165, Fla. Stat.; Chapter 200, Fla. Stat.l and other applicable provisions of
law (hereinafter referred to as the "Act").
Section Three: Creation of Bonita Shores and Little Hickory Shores Street
Lighting Hunicipal Service Taxing Unit and Boundaries.
There is hereby created and established the Bonita Shores and Little
Nickor~ Shores Street Lighting Hunicipal Service Taxing Unit (hereinafter
referred to as the "MSTU"). The boundaries of the MSTU are as follows:
Bonita Shores Unit I as recorded in Plat Book 3, Page 1, of the
Public Records of Collier County, Florida; and
Bonita Shores Unit 2 as recorded in Plat Book 3, Page ,3, of the
Public Records of Collier County, Florida; and
Bonita Shores Unit 3 as recorded in Plat Book 3, Page 80, of the
Public Records of Collier County, Florida; and
Bonita Shores Unit 4 es recorded in Plat Book 10, Page 33, of the
Public Records of Collier County, Florida; and
Little Hickory Shores Unit 1 es recorded in Plat Book 3, Page 6, of
the Public Records of Collier County, Floridal and
Little Hickory Shores Unit 2 as recorded in Plat Book 3, Page 79, of
the Public Records of Collier County, Florida; and
Little Hickory Shores Unit 3 as recorded in Plat Book 3, Page 9?, of
the Public Records of Collier County, Ploridal and
Little Hickory Shores Unit 3 Replat aa recorded in Plat Book 6, Page
2, of the Public Records of Collier County, Florida.
Section Four: Purposes and Governing Body.
The ~STU is created for the purpose of providing street lighting for all
platted etreets within the Bonita Shores and Little Hickory Shores Subdi-
visions, end to do all things reasonably necessary to provide said lighting
within said HSTU. The governing body of the NSTU shall be the Board of County
Co~tssionars of Collier County, Florida.
Section Fives Funding and Levy of Taxes.
The street lighting program designated pursuant to Section ~hrea
~dinance shall be pr~ldfd fr~ ~axes within
the outhority of Section 200.085, Fla. Stat., the $ovorning body of the MSTU is
authorized to levy in excess of the rolled-back millage rate computed pursuant
to Section 20o.o6s(I), Fla. Stat., provided such levy has been approved by
m]ority vote of the qualified electors in the NaT0 voting in an election
celled for ouch purpose. The levy not to exceed 0.7 mills shall bo for the
purposes specified in Section Three of thio Ordinance. Such taxes shall be
levied and collected at the sams time and in the same manner es provided by law
for County taxes. The Property Appraiser and the Tax Collector of Collier
CountT, Florida ere specifically authorized and directed to take all necosseW
and desirable action in furtherance of thio Section Four.
'Section Six: Millage Referendum.
A referendum of tho qualified electors residing in the MSTU is by
resolution celled to bo held on September 4, 1984, if possible end if not
then, on November 6, 1984 to deternine whether or not an NSTU tax millage not
to exceed 0.7 mills shall be levied to provide street lighting for all platted
streets within the Bonita Shores and Little Hickory Shores subdiv~sions and to
do all things reasonably necessary to provide said lighting within said HSTU.
Section Seven: Soverability.
In the event that any word, clause, phrase, sentence, or paragraph hereof
shall bo held invalid by any Court of competent ~uriediction, such holdings
shall have no effect on any ocher word, clause, phrase, sentence, or paragraph
hereof.
Section Ei;bt= Conflict.
All resolutions, ordinances, or ocher actions taken by chis Board in
conflict or inconsistent herewith are hereby repealed insofar as there is
conflict or inconsistency.
Section Nine: Effective Date.
Thio Ordinance shall take effect upon filing with the Secretary of State.
