WHEREAS, Barnett Banks Trust Company N.A., Trustee petitioned
the Board of County Commissioners to amend the Berkshire Lakes
Planned Unit Development Ordinance, Collier County Ordinance 83-46;
NOW, THEREFORE BE IT ORDAINED by the Board of County Co~is-
sioners of Collier County, Florida:

SECTION THREE:
Ordinance No. 83-46 PUD Document Section 2.07 shall b~ amended
to read as followst
1.07 PROJECT DENSITY:
The total acreage of the BERKSHIRE I~S property is approxi-
mately $038 1093 acres of which 35 acres wiii-be has been
deeded to the County. The maximum number of dwelling units to
be built on the total acreage is 1,200. The number of drilling
units per gross acre is approximately ~Tg~ 3.84. The density
on individual, parcels of land throughout the project may vary
according to the type of housing placed on each parcel o£ land.
SECTION FOUR:
Ordinance No. 83-46, PUD Document Section 2.09 shall be amended
to read as follows:
2.09 DEVELC?MENT SEQUENCE AND SCHEDULE:
The applicant has not set "stages" for the development of the
property. Since the property is to be developed over an
estimated 20 year time period, any projection of project
development can be no more than an estimate based on curren~
marketing knowledge. The estimate may of course, change
depending upon future economic factors. The following schedule
indicates, by years, the estimated absorption of units for the
estimated 20 )'ear development period.

SECTION FIVE:
Ordinance No. 83-46 FUD Document Section 2.12 shall be amended
to read as follovs:
2.12 I~CEPTIONS TO THE COLLIER COUNTY SUBDIVISION REGULATIONS:
The follo~tng requirements shall be waived:
a. Article XI, Section 10: Where such monuments occur within
street pavement areas, they shall be installed in a
typical water valve cover, as prescribed in the current
Collier County Standards.
b. Article XI, Section 1TH: Such streets shall not exceed one
thousand (1,000) feet in length.
c. Article XI, Section 17J, requiring curved streets to have
a minimum tangent of 100 feet at intersections.
~. Article XI, Section 16f Sidewalks (Waive requirement for
sidewalks on both sides of all collection streets, on
one side of each marginal access e%reet and local
street). Walkway and/or bicycle path locations will be
indicated on the project construction plans when those
are submitted to the County for approval.
Article X, Section 19: Street Name Markers and Traffic
Control Devices. Street name signs shall be approved by
the County Engineer but not meet the U.S.O.T.F.H.W.A
Manual on Uniform Traffic Control Devices. Street pave-
ment painting, striping, and reflective edging require-
ments shall be waived.
Article II, Section lYG: Street Pavement Widths (Waive
requirements for local roads to have tvo (2) twelve foot
lanes, subject to the approval of the Count7 Ensineer.
IL: Article XIr Section 171: Curb Radii (Reduce requirement
from forty (40') foot radius to thirty (30') foot
r.dius at local to local road and local to minor
collector road intersections only).

2.~! LAKE SITING
As depicted on Exhibit "H' Master Plan Development Plan, and Exhibit
"H-l"~ Parcel "F" Master Plan lakes and natural retention areas
have been sited ad.lacent to existing and planned roadwaye. The
~oals of this are to achieve an over-all aesthetic character
for the project, to permit optimum use of the land, and to
increase the efficiency of tbs water management network.
Accordingly, the setback requirements described in Ordinance
80-26,Section SA, may be reduced with the approval of the
County Engineer. Fill material from lakes is planned to'be
utilized within the project, however, excess fill material
may be utilized off-site.
SECTION SEVEN:
Ordinance No. 83-46 PUD Document Section 3.01 shall be amended
to read as follows:
3.01 PURPOSE
Tbs purpose of this Section ie to set forth the regulatione for
the areas designated on Exhibit "H", Master Development plan
and Exhibit H-l, Parcel "F" Master Plan, as Single-Family
Residential.
SECTION EIGHT:
Ordinance No. 83-16 PUD Document Section &.01 shall be amended
to read ae follows:

The purpose of this Section is to set forth the regulations

The purpose of this Section is to set forth the regulations for
the areas designated on Exhibit "H", Master Development Plan
and Exhibit H-l, Parcel "F" Master Plan, aa Golf Course.

t.02 PERMITTED USES AND STRUCTURES
No building or structure, or part thereof, shall be erected,
altered or used, or land or water used, in whole or in part,
for other than the following:
A.Permitted Principal Uses and Structures
1) Golf Course
B. Permitted Accessor~ Uses and Structures Accessor~ uses
customarily associated with the principal uses permitted
in this district including but not limited to:
1) Clubhouses, pro-shop, practice driving range and
other customary accessory uses of golf ccurses, or
other recreational facilities.
2) Golf course maintenance shops and e~uipment storage.
3. ~) Small comercial establishment~, incl~ding gift
shops, golf equipment sales, restaurants, cocktail
lounges, and similar uses, intended to exclusively
serve patrons of the golf course or other permitted
recreational facilities, subject to thc provisions of
the applicable supplementary regulations of the
Zoning Ordinance of Collier County.

and other types of facilities intended for outdoor
recreation.
