AN ORDI. NANCE AMENDING SECTION 8 OF
ORDINANCE NO. 83-50 WHICH PROVIDES
FOR THE REGISTRATION AND REGULATION
OF OPERATORS OF MOTOR VEHICLES FOR
HIRE WITHIN COLLIER COUNTY; SAID
AMENDMENT ESTABLISHING A REVISED
SCHEDULE OF RATES AND ADDITIONAL
CHARGES WHICH REFLECT AN INCREASE.
PROVIDING FOR CONFLICT AND
SEVERABILITY; AND PROVIDING AN
EFFECTIVE DATE.
WHEREAS, on December 3, 1985, at an advertised public
heazing on a proposed ordinance repealing Ordinance No. 83-50,
certain questions arose regarding changes in the minimum
liability insurance requirements of the State of Florida for
motor vehicles for hire, said changes causing the public hearing
on the proposed ordinance to be continued to January 21, 1986;
and
WHEREAS, operators of motor vehicles for hire have been
operating under the rate schedule established on November 8,
1983, in Ordinance No. 83-50; and
WHEREAS, since the adoption of Ordinance No. 83-50 the cost
of liability insurance for operators of motor vehicles for hire
has substantially increased; and
WHEREAS, the rate schedule proposed in this Ordinance was
previously advertised and included in the proposed Ordinance to
repeal Ordinance No. 83-50, consideration of which was continued
from December 3, 1985, to January 21, 1986; and
WHEP~AS, all persons who registered to speak at the public
hearing on the proposed Ordinance to repeal Ordinance No. 83-50
were heard, and no persons raised objection to the rate schedule
contained therein; and
WHEP~AS, it would be inequitable and an unreasonable
hardship on operators of motor vehicles for hire to have to
continue to operate during their busiest season at the rates
established in Ordinance 83-50, which rates were adopted prior to
substantial increases in liability insurance requirements for
such operators; and
WHEREAS, in accord with Section 125.66(3), Florida Statutes,
and based upon the above considerations, the Board of County
Commissioners does hereby declare by a four-fifths (4/5) vote
that an emergency exists, that immediate enactment is necessary,
and that adequate public notice has been given of the changes
proposed below and that the normal notice requirements for
adw~rtising ordinances have been substantially complied with and
should be waived;
NOW THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
CO~IISSIONERS OF COLLIER COUNTY, FLORIDA:
SECS?ION 1.
Section 8 Of Ordinance No. 83-50 Which Provides A Schedule
Of Rates And Charges For Operators Of Motor Vehicles For Hire
A~nended.
Section 8 of Ordinance No. 83-50 is hereby amended to read
as follows:
SECTION 8. SCHEDULE OF RATES ESTABLISHED; ADDITIONAL
CHARGES~ REVIEW AND REVISION.
(a) For purposes of rate regulation of
Taxicabs, the County is hereby divided into Zones A, B, and C,
which Zones are graphically depicted on Exhibit I, attached
hereto and incorporated herein by reference. A general
description of said Zones is included in Exhibit I?--~-~n
Rates and charges by owners and operators of vans~ limousines{
trolleys and buses shall be unregulated.
(b) The following schedule of maximum Rates is hereby
established for Taxicabs operating in Zones A and B of Collier
County (See Exhibit I).
One Dollar and ~}88 75/100 ~6~=~$~ ($1.75) for the
first one-tenth (1/10) mile and ten twenty-five cents
~}8%~ (25¢) for each ~ne two tenths ~½8~ (2/10) mile
thereafter.

(c) The following maximum charges are hereby established in
addition to the maximum Rates set forth in subsection (a)
thereof:
(1) ~w~ve-B~a~s-~$~?0e~ Fifteen Dollars ($15.00)
per hour waiting time when requested by the passenger after
initial pickup.
(2) Two Dollars ($2.00) each for trunks and foot
lockers.
(3) Twen~y-P~e-~en~s-~5~ One dollar ($1.00) per
person over one in each party from pickup point to
destination.
(4) Twenty-Five Cents (25¢) each bag of groceries or
other merchandise over two if loaded by driver.
(5) Twen%y-P&ve-~en~s-~R~%~ Fifty Cents (50¢) each
piece of luggage over one per passenger.
(6) Twen%y-P&~e-~enes-~R~%~ ~ifty Cents (50¢) each
intermediate stop {o~ requested by a passenger en route from
pickup point to destination.
(7) One Dollar ($1.00) for each bike or pet kennel.
(d) A $5.00 maximum zone charge may be c~arged for any Fare
originating or terminating within Zone B (See-.Exhibit I). This
zone charge is in addition to the maximum Rates identified above
for ~ones A and B.
(e) Zone C (See Exhibit I) Rates shall be unregulated.

~g~ (f) The Co~ission may, from time to time, require the
o~ers and operators of Taxicabs, Vans or Limousines to appear
before the Co~ission for the purpose of reviewing their said
rates for reasonableness. And said owners and operators ma~f
petition the Co~ission for a review of their rates.

(g) Any passenger of any Taxicab may make demand for a
receipt showinq his fare and such receipt shall be given by the
driverr showing the number of the cabf the date and hour of the
deliuery of the receipt and the amount of the fare paid by the
passE~nger.
SECTION 2. CONFLICT AND SEVERABILITY.
Should any section or provision of this Ordinance be
declared by a court of competent jurisdiction to be
unconstitutional or invalid, such decision shall not affect the
validity of this Ordinance as a whole, or any part thereof other
than the part so declared to be unconstitutional or invalid.
SECTION 3. EFFECTIVE DATE.
This Ordinance shall take effect when a copy has been
accepted by the postal authorities of the Government of the
United States for special delivery by registered mail to the
Florida Depa~tmen~ of State.
