Ordinance 85-40, ORDINANCE NO. 85- ~0 AN ORDINANCE AMENDING COLLIER COUNTY ORDINANCE NO. 78-16, THE COLLIER COUNTY ANIMAL CONTROL ORDINANCE; AMENDING S~CTION TWO (S) TO PROVIDE THAT EVERY DOG AND CAT OVER SIX MONTHS OF AGE SHALL BE CURRENTLY VACCINATED RATHER THAN ANNUALLY VACCINATED; AMENDING SECTION FIVE (A) (1) TO DELETE THE REQUIREMENT OF VACCINATION PRIOR TO RELEASE OF IMPOUNDED ANIMALS TO OWNERS; PROVIDING AN EFFECTIVE DATE. WHEREAS, different rabies vaccinations provide immunity to animals for various designated periods of time as approved by the U. S. Department of Agriculture and recognized by the State of Florida Department of Health and Rehabilitative Services; and WHEREAS, with regard to impounded animals, the requirement of vaccinating such animals prior to release to owners causes unjustified animal overcrowding and delays; NOW THEREFORE BE IT ORDAINED BY THE BOARD OF COUNTY COMMIS- SIONERS OF COLLIER COUNTY, FLORIDA thatz SECTION ONE: SECTION TWO (B), Collier County Ordinance NO. 78-16, shall be amended to read as follows: SECTION TWO: LICENSE CERTIFICATE, TAGS AND VACCINATION REQUIRED A. Every owner of a dog or cat over the age of six (6) months shall obtain a Collier County license for such animal. 1. The license will be issued for a period of one year and required to be renewed annually, thereafter. 2. No license shall be issued unless such animal has been vaccinated for rabies and proof of vaccination .-~present~c~ to licensing authority. 3. ~h~ 'certificate of license shall contain the name of the owner, address, breed and sex of animal, color or other descriptive data. 4. The metal license tag shall be affixed to the animal's collar or harness at all times excepts When the animal is confined, securely fenced or participa- ting in an organized match, show, trial, or obedience training. 6. The license issued under this section shall not be transferable from animal to animal nor from . owner to owner. 7. License and tag shall be obtained from persons designated by the County Manager. These persons shall complete license forms provided by the Director of Animal Control for the registration and licensing of dogs and cats, and submit the completed forms to the Director of Animal Control. B. Every owner of a Dog or Cat over six (6) months of age shall have such animal currently vaccinated enn~e~y for rabies. In addition every owner shall provide proof of vaccination, upon demand of the Health Officer or his designee or other persons authorized to enforce this Ordinance. 1. No vaccination is required if a licensed veterinarian certifies that the vaccination would endanger the animal's health. A temporary license will be issued in this matter until the animal can be vaccinated. C. Cost of license for dog or cats shall be: ................ Dog $6.00 Neutered $8.00 Non-Neutered Cat $6.00 Neutered $8.00 Non-Neutered 1. Cost of obtaining duplicate license tags shall be $4.00. 2. The cost of license will be waived for~ Persons who are legally blind or deaf whose dog is a seeing-eye or a hearing-ear dog or law enforcement dogs certified as such by e court of law. License Fees established by this O~dinance shall or may from tame to time be revised by Resolution of the Board of County Commissioners. SECTION TWOs SECTION FIVE (A) (1}, Collier County Ordinance-No. 78-16, shall be amended to read as follows~ SEC%','ON FIVEr ADOPTION, REDEMPTION AND EUTHANIZATION OF ANIMALS A. Impounded animals not suspected of having an infectious or contagious disease shall be held a minimum of five (5) days for redemption by the owner. The Director of Animal Control shall attempt to contact the owner of an animal impounded before its humane disposition. Dogs, cats or other animals not claimed within the five (5) day period, may be adopted, sold, or euthanized. 1. Animals shall be released to owners on presentation of proof of ownership, or adopted, or sold, veee~n~n? ~ee~s~n~-~ upon payment of costs and fees. 2. Ali persons adopting or purchasing any dog or cat from public or private animal shelters, that is, N%umane Society or Animal Control agency operated by a public agency shall have the animal sterilized by a licensed veterinarian' within 30 days or prior to sexual matur- ity. The adoptor 'or purchaser shall enter into a written agreement guaranteeing such sterilization and shall submit a sufficient deposit as provided for in Florida Statutes. 3. Adoption and sale fees: a. A fee of ten dollars ($10.00) shall be charged for each dog or cat sold or adopted. b. A fee for all other animals sold or adopted will be determined by market value of the animal.
