WHEREA~, on September 14, 1976, the Board of County Co;missioners
approved Ordinance 76-A1, which established the Lely Country Club PUDI
and
W~EREAS, on November 22, 19'., the Board of County Co,~.issionera
spprowed Ordinance 77-60, which uended the Lely Country Club PUD by
adding language dealing with overhead distribution lineal and
%~t~KEAS, on Dseember A, 1984, the Board of County Commissioners
approYed Ordinance 8~-85, which amended the Lely Country Club PUD by
amending the types of unite in various tractsl and
WHEREAS, William C. MeAnly, representing Augusta Court Condominium
Association, Inc., petitioned the Board of County Co;=issieners to amend
Ordinance 76-tl as previously amended by Ordinanca 77-60 and Ordinance
81-8~, to allow one private drive into Augusta Court CondominiumI
IOW, THEREFOKE BE IT ORDAINED BY THE BOARD OF COUNTY COMMI$.~IONERS
OF COLLIER COUN'I'~, FLORIDA:
SECTION ONE:
Ordinance Number 76-tl, as~ previously amended by Ordinance 77-60
and Ordinance 8&-85, Section &.~.7., ~uffer Zone Along S~-864, shall be
as~nded as follows:
4.4.7. BUFFER ZONE ALONG $R-864: ~
Vehicular access tq ~R-864 other chan~a platted streets
is prohibited, exc~pl: that a private ~rance drive,
located 910.00 feet, more or less, west of the
intersection of the centerline of Augusta Boulevard and
the south right of wa~ line of SR-864~ may be permitted
by the Director. This entrance is for the sole purpose
of in~ress and e~ress into the Augusta Court Condominium
a private condominium, and is not intended to be access
into the Lely Country Club Planned Unit Development.
Prior to permittin~ such vehicular acceso, the Director
shall determine that no traffic safety hazard will be
created. A stri~ of land ½~-½~ 2--0 ft. wide, along the
entire length of Tracts E and L and adJacen~ to the
southerly boundary of ~R C_~K-864 right of way, shall be
reserved f~r future right of way widening and shall be
dedicated to the appropriate governmental agency at the
time of expansion of SR CR-864 and shall be incorporated aa
such on the subdivision master plan.

A vegetation buffer screen shall be installed along the
north aide of the local access street right of way
immediatsly south of the ½~-t~ 2_~0 ft. reserve strip, as
part of the overall project improvements.
The developer shall provide an easement of up to 20 feet,
as referenced above, dependin~ upon final desi~
requirements~ alon~ the south side of CR-864 for future
drainage and bike path facilities to be constructed by
the County, and a right turn lane for the proposed new
driveway. The right turn lane shall be constructed as a
part of the four lanins project, with its cost to be paid
by the developer.
Approval of this driveway does not imply a medJsn opening
upon the four laning of CR-864.
Native species shall be utilized, where available, to the
maximum extent peas~ , e in the site landscapin~ design.
A landscapin~ plan ~,i~l be submitted to the Natural
Resources Manageme~ Department and the Co~..~nity
Development Divest n for their review and approval. This
plan will depict the incorporation of native species and
their mix with other species, if any. The goal of site
landscaping shall be the re-creation of native vegetation
and habitat characteristics lost on the site durtn~
construction or due to past activities.
Any installation requirtnt a CCPHU permit must submit
plans for review and approval.
Upon completion of the driveway, all other existin~
access/driveways be deleted/closed.
SECTION TI/0:
This Ordinance shell become effective upon notice that it has been
received by the Office of the Secretary of State.
