WHE~S, on April 8, 1986 the Board of County Comission~rs accepted a
petition fr~ property o~ers to create the Sabal Palm Road Extension PavinE
Assessment District; and

Section 1: Creation, Boundaries, Purposes.
The Sabal Palm Road Extension Hunicipal Service Taxing and Benefit Unit
(the "Unit") is hereby created, with boundaries described as follows:
ALL LANDS IN SECTIONS 24, 25 AND 36, TOWNSHIP 50 SOUTH
RANGE 26 EAST, COLLIER COUNTY, FLORIDA
and
ALL LANDS IN SECTIONS 15, 16, 17, 18, 19, 20, 21, 22,
23, 26, 27, 28, 29, 30, 31, 32, 33, 34 AND 35, TOWNSHIP
50 SOUTH, RANGE 27 EAST, COLLIER COUNTY, FLORIDA
The Unit hereby created and established ia for the purpose of providing a ,
preliminary engineering study for the aesign, construction, and financing of
roadway improvements within the Unit and to do all things reasonably necessary
in connection tker.~.l.~.h~, a~d" for the purpose of exercising those powers
authorized by Florida Statqtes Chapter 125 and other applicable laws.
Section 2: povernin~ Board, Powers and Duties.
The governing~"~oard of the Unit shall be thc Board of County
Co-~issioners of Collier County, Florida with the power and duty to conduct
the.affairs of the Unit as prescribed by Florida Statutes.
Section 3: ' Annual Budget, Taxin~ Authority.
For the purpose of carrying into effect this article, the Board o'f County
Commissioners shall annually, at the time required by general budgetary law,
make an itemized estimate of the amount of money required to carry out the
business of the District for the next fiscal year, which shall be from October
I to and including September 30 following. The estimate shall have for what
purpose the monies are required and the amount necessary to be raised by
taxation within the District. At the time and place for fixing the annual
rate of taxation for County purposes, the Board shall fix and cause to be
levied on all property within the district subject to taxatiom~ a mi~age
_.sufficient to meet the requirements of the estimate; however~the ~.}al
millage shall not exceed the millage authorized by law for munic~al me--ce --fl
taxing or benefit units. ~ --

Section 5: Construction snd Severabllit~.
1. Tht, Crdinance shall be liberally construed to effectuate its public
purpose.
2. If an)' portion, phrase or word of this Ordinance i$ held invalid or
unconstitutional, such portion, phrase or word shall be deemed a separate
distinct and iudependent provision and such holding shall not affect .the
validity of the remaining portion.
Section 6: Effective Date.
This Ordinance shall be come effective upon receipt of acknowledgemaut
from the Secretary of State that this Ordinance ha8 been filed with that
office.
