BE IT ORDAINt~ BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER COUNTY,
FLORIDA:
Section One: Ttmbercreek Pha,~e 2 Street Li~htin~ Municipal Service Taxin~ Unit
Crea~:ed~ Boundaries.
Pursuant to Chapter 125 of the Florida Statutes, the Timb~:rcreek Phase 2
Street Lighting Municipal Service Taxing Unit is hsreby created for the
purpose of providing street Lighting to the residents of the taxing unit, the
boundariee of which are hereimafter described:
All of Timbercreek Phase: 2 (Lely Country Club) as recorded in Plat
Book 13, Pages 94-95 of the Public Records of Collier County,
Florida.
Section Two: Governing Body.
The governing body of the Unit shall be sx-offieto the t~oard of County
Co~issioner~ of Collier Count. y, Florida.
Section Three: Pu__r~ose~ Powe':~.
The Unit is formed for the purpose of providing street lighting within the
boundaries of the above-deseribed subdivision and to that end shall possess all
the powers to do all things reasonably necessary to provide such services,
including ownership or rent~;1 of property, poles, wires, conduits, lights,
meters, and the power to maintain the same and to enter into contracts for
providing the sam~ and the electric current to operate any lighting system
there~n installed.
Section Fcur: Annual Eatimat{:s of Expenses} Taxation Rate.
For the purpose of carrying into effect this Ordinance, the Board of
County Commissioners she'll an'nually, at the time required by general budgetary
law, make an itemized estimate: of the amount of money required to carry out the
business of the Unit for the next fiscal year, which shall be from October I to
and including September 30 fo].lowtng. The estimate shall have for what purpose
the monies are required and the amount necessary to be raised by taxation
within the Unit. At the time and place for fixing the annual rate of taxation
· for county purposes, the Board shall fix and cause to be levied on all property
~thin the Unit subject t(, taxation a millage sufficien~ to meet the
requirements of th,~ estimate; provided, however, the total millage shall not
exceed the millage authorize~ by law for municipal service ta~.~ng or benefit
units.
Section Five: Tax Assessment And Collection.
Taxes herein provided for shall be assessed and collected in the same
manner and form as provided for the assessment and collection of general county
taxes and subject to the same fees for assessing and collecting as general
county taxes.
Section Six: Construction.
This Ordinance shall be liberally construed to effectuate its public
purpose.
Section Seven: Effective Date.
Effective date of this Ordinance shall become effective as provided by
law.
