Ordinance 86-38,RECEIVED -- '" ' --,emw',. ..... ..~,,.,~, AMENDING ORDINANCE 82-2, THE COMP/LENEN-;°~ ClLLII~ Ls;~I'~'~'~'SiVE ZONING REGULATIONS FOR THE UNINCORPORATED AREA OF COLLIER COUNTY BY A2~EbrDING SECTION 10.6, TF2~ORARY~_A US.;~ PERMITS, SUBSECTION 10.6.C, TEMPORARY SALES, SPORTS EVENTS, RELIGIOUS EVENTS, AND COMMUNITY EV]SNTS, TO INCREASE THE TWO (2) WEEK PEPd~IT LIMIT TO FI';£ (5) WEEKS FOR CHRISTMAS TREE SALES, A]fO TO PROVIDE AN EFFECTIVE DATE. WHEREAS, the temporary per~i, t is intended to provide for temporary uses which vary in type and degree as well aa in length of rims involved; and WHEREAS, Christmas tree sales are limited to a non-renswable two-week pen:it; and W~EREAS, the Christmas season usually is considered to begin immediately ~fter Thanksgiving and extend to Christmas; and WHEREAS, organizations and businesses selling Christmas trees generally de,ire to begin sales immediately after Thanksgiving with · sales ending by Christmas which is approximately a four (4) week period; NOW, THEREFORE BE IT ORDAINED by the Board of County Ccnmmissioners of Cellier County, Florida: SECTION ONE: Collier County Ordinance 82-2, Ssction 10.6, Temporary Use Permits, Subsection i0.6(c) Temporary Sales, Sports Events, Religious Events, and Community Events, shall be amended aa follows: / I) In the ca~e of temporary sales, such as &hr~sem~$-e~ee ee~es? grand openings, going out of business sales \ (exclusive of garage sales, lawn sales a~d similar private home sales), special promotional sales, sports events, religious events and community events, ':be Zoning Director m&y grant a non-renewable two-week permit for such events . en~ In the case of Christmas tree sales, the Zonin~ Director may grant a non-renewable five week permit. These temporary permits may include :he placement of temporary signs, merchandise, temporary structures and equipment, and temporary mobile home aa an office, but not for residency. If the temporary ii I I 2) u~e is not diecontinued upon expiration of the permit it ~hall be deemed a violation of the Zoning Ordinance and shall be subject to the penalties therein. In making such approval, the Zoning Director may stipulate the following requirements as he deems appropriate to the CABS: {a) Traffic Safety Measures. (b) Additional Parking Requirements. (c) Linttted Activity Hours. (d) Watchman, Fencing, Lighting. (e) Sanitary Facilities'. (f) A faithful performance bond to guarantee compliance with the conditions of the permit. SECTION TWO: This Ordinance shall become effective upon receipt of notice that it has been filed by the Office of the Secretary of State.
