PROVIDING AN EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of Collier
County, Florida, adopted Ordinance No. 78-15 on April 25, 1978
which established a uniform policy and procedure for the issuance
of a license to carry a concealed pistol on the person and is
kno~ as the "Collier County Uniform Pistol Licensing Ordinance";
and
WHEREAS, the Board of County Commissioners adopted Ordinance
No. 79-86 on October 23, 1979 which amended Ordinance NO. 78-15
by providing that a pistol license is not valid in bars and that
the application fees for a pistol license be $75.00 for both new
and renewal applications; and
WHEREAS, Chapter 87-24, Laws of Florida, amended Section
790.06, Florida Statutes, authorizes the Department of State
rather than the counties to issue licenses for carrying a
concealed weapon or firearm; and
WHEREAS, Chapter 87-24, Laws of Florida, becomes effective
October 1, 1987; and
WHEREAS, the policy, procedures and requirements established
by Collier County Ordinances 78-15 and 79-86 will no longer be
applicable as of October 1, 1987.
WHEREAS, the Board of County Commissioners finds it
appropriate and in the best interest of the citizens of Collier
County to repeal Ordinances 78-15 and 79-86.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY
CO~MISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE: Repeal of Ordinance No. 78-15 and Ordinance No.
79-86
Collier County Ordinance No. 78-15 which established a
uniform policy and procedure for the issuance of a license to
carry a concealed pistol on the person and is known as the
"Collier County Uniform Pistol Licensing Ordinance"
is hereby repealed in its entirety.
Collier County Ordinance No. 79-86 which amended Ordinance
No. 78-15 by providing that a pistol license is not valid in bars
and that the application fees for a pistol license be $75.00 for
both new and renewal applications is hereby repealed in its
entirety.
SECTION TWO: Conflict and Severability
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent Jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
SECTION THREE: Effective Date
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
