AN ORDINANCE REPEALING ORDINANCE NO.
84-69 WHICH CREATED THE PINE RIDGE
SUBDIVISION STREET LIGHTING ML~ICIPAL
SERVICE TAXING UNIT; PROVIDING FOR
CONFLICT AND SEVERABILITY; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of Collier
County, Florida, adopted Ordinance No. 84-69 on September 25,
1984 creating the Pine Ridge Subdivision Street Lighting
Municipal Service Taxing Unit as a special purpose district; and
WHEREAS, Ordinance No. 84-69 called for a referendum
election of the qualified electors residing in the Municipa~
Service Taxing Unit (MSTU) to be held on November 6, 1984 for the
purpose of determining whether a tax millage not to exceed 0.50
mills should be levied to fund the MSTU; and
WHEREAS, the qualified electors declined to approve a tax
levy of 0.50 mills to fund the MSTU; and
WHEREAS, Ordinance No. 84-69 is as a consequence no longer
applicable or necessary; and _~.
WHEREAS, the Board of County Commissioners finds ~t ~
appropriate and in the best interests of the citizens ~f Collier
Ccunty to repeal Ordinance No. 84-69. 7,
NOW, THEREFORE, BE IT ORDAINED BY THE BOA~AD OF COt~TY c~
COM~ISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE: Repeal of Ordinance No. 84-69
Collier County Ordinance No. 84-69 which created the Pine
Ridge Subdivision Street Lighting Municipal Service Taxing Unit
as a special purpose district under Cha~ter 125, Chapter 165, and
Chapter 200, Florida Statutes, is hereby repealed in its
entirety.
SECTION TWO: Conflict and Severabilit~
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If ~.ny phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
SECTION THREE: Effective Date
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
