AN ORDINANCE REPEALING ORDINANCE NO.
84-48 WHICH CREATED THE BONITA SHORES ~

LIGHTING MUNICIPAL SERVICE TAXING UNIT; ~ ~
PROVIDING FOR CONFLICT AND SEVERABILITY;''~
PROVIDING AN EFFECTIVE DATE. ~ -~
WHEREAS, the Board of County Commissioners of Collier
County, Florida adopted Ordinance No. 84-48 on July 24, ~984 ~
creating the Bonita Shores and Little Hickory Shores Street
Lighting Municipal Service Taxing Unit as a special purpose
district; and
WHEREAS, Ordinance No. 84-48 called for a referendum
election of the qualified electors residing in the Municipal
Service Taxing Unit (MSTU) to be held on September 4, 1984 for
the purpose of determining whether a tax millage not to exceed
0.7 mills should be levied to fund the MSTU; and
WHEREAS, qualified electors declined to approve a tax levy
of 0.7 mills to fund the MSTU; and
WHEREAS, Ordinance No. 84-48 is as a consequence no longer
applicable or necessary; and
WHEREAS, the Board of County Commissioners finds it
appropriate and in the best interests of the citizens of Collier
county to repeal Ordinance No. 84-48.
NOW, THEREFOR2, BE IT ORDAINED BY THE BOARD OF COUNTY
COMMISSIONERS OF COLLIER COUNTY, FLORIDA that:
SECTION ONE: Repeal of Ordinance No. 84-48
Collier County Ordinance No. 84-48 which created the Bonita
Shores and Little Hickory Shores Street Lighting Municipal
Service Taxing Unit as a special purpose district under Chapter
125, Chapter 165, and Chapter 200, Florida Statutes, is hereby
repealed in its entirety.
SECTION TWO: Conflict and Severability
In the event this Ordinance conflicts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
SECTION THREE: Effective Date
This Ordinance shall become effective upon receipt of notice
from the Secretar? of State that this Ordinance has been filed
with the Secretary of State.
