AN ORDINANCE REPEALING COLLIER COUNTY
ORDINANCE NO. 77-39 WHICH ESTABLISHED
THE MARCO ISLAND FIRE CONTROL MUNICIPAL
SERVICES TAXING DISTRICT; PROVIDING FOR
CONFLICT AND SEVERABILITY; PROVIDING AN
EFFECTIVE DATE.
WHEREAS, the Board of County Commissioners of Collier
County, Florida, adopted Ordinance No. 77-39 on August 9, 1977
establishing the Marco Island Fire Control Municipal Services
Taxing District special purpose district; and
WHEREAS, Special Act 65-1413. Laws of Florida, created and
established the Marco Island Fire Control District as an
Independent District; and
WHEREAS, Special Act 78-491, Laws of Florida, amended
Special Act 65-1413, to authorize emergency rescue services and
to remove the limitation upon the amount which may be annually
realized from authorized millage; and
WHEREAS, Special Act 79-444, Laws of Florida, amended
Special Act 65-1413, tu validate the creation of the Marco Island
Fire Control District; and
WHEREAS, Special Act 80-595, Laws of Florida, amended
Special Act 65-1413, to provide that the emergency rescue service
previously authorized may include transportation to a health
facility; and
WHEREAS, Special Ac~ 82-282, Laws of Florida, amended
Special Act 65-1413, to authorize the District to provide
transportation to a health facility both within and outside of
the District under emergency conditions; and
WHEREAS, Special Act 84-415, Laws of Florida, amended
Special Act $5-1413, to provide authorization for the District to
borrow money and issue evidences of long term indebtedness for
the singular purpose of capital expenditures;and
WHEREAS, the Dependent District created by County Ordinance
No. 77-39 is as a consequence no longer applicable or necessary;
and

WT{EREAS, the Board of County Commissioners finds it
appropriate and in the best interests of the citizens of Collier
County to repeal Ordinance No. 77-39.
NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNT"f
COMMISSIONERS OF COLLIER COUNt, FLORIDA that:
SECTION ONE: Repeal of Ordinance No. 77-39
Collier County Ordinance No. 77-39 which established the
Marco Island Fire Control Municipal Services Taxing District as a
special purpose district under Chapter 125, Florida Statutes, is
hereby repealed in its entirety.
SECTION TWO: Conflict and Severabilit¥
In the event this Ordinance conf].icts with any other
ordinance of Collier County or other applicable law, the more
restrictive shall apply. If any phrase or portion of this
Ordinance is held invalid or unconstitutional by any court of
competent jurisdiction, such portion shall be deemed a separate,
distinct and independent provision and such holding shall not
affect the validity of the remaining portion.
SECTION THREE: Effective Date
This Ordinance shall become effective upon receipt of notice
from the Secretary of State that this Ordinance has been filed
with the Secretary of State.
