Ordinance 87-007ORDINANCE NO. 87-7 .AN EMERGENCY ORDINANCE AMENDING COLLIER .COUNTY ORDINANCE NO. 86-78, AN ORDINANCE '-WHICH 'ESTABLISHED THE COLLIER COUNTY ::~PLANNING COMMISSION CITIZENS ADVISORY '~'~COMMITTEE; AMENDING S~CTION TWO TO PROVIDE '.--~THAT THE COMMITTEE SHALL CONSIST OF 25 "~iU~I~ATHER THAN 21 MEMBERS; AMENDING SECTION .~-'Si~OUR TO PROVIDE THAT 15 RATHER THAN 13 - ~4EMBERS SHALL CONSTITUTE A QUORUM; PROVIDING FOR CONFLICT AND SEVERABILITY; PROVIDING FOR DECLARATION OF EMERGENCY AND AN EFFECTIVE DATE. NOW, THEREFORE, BE IT ORDAINED BY THE BOARD OF COUNTY COMMISSIONERS OF COLLIER cOUNTY, FLORIDA: SECTION ONE: Creation Of The Citizens Advisory Committee For The Comprehensive Plan; Jurisdiction. The Board cf County Commissioners (BCC) has designated the Collier County Planning Commission (CCPC) as the local planning agency pursuant to Section 163.3174, Florida Statutes, to conduct the comprehensive planning program and prepare a comprehensive plan and to make recommendations regarding the adoption of the comprehensive plan. In order to obtain participation by the public and encourage public comment, the BCC hereby establishes and creates the Collier County Planning Commission Citizens Advisory Committee (hereinafter referred to as the Citizens Advisory Committee). The Citizens Advisory Committee shall have jurisdiction for the unincorporated area of Collier County, Florida. ~ SECTION TWO: Composition Of The Citizens Advisory Conunittee. Members of the Citizens Advisory Committee shall be permanent residents and electors of Collier County. Consideration shall be given to those persons who have shown an interest in public affairs. In establishing membership on the Citizens Advisory Committee, representation of the full spectrum of the Citizenship if Collier County shall be sought as well as balanced geographic representation. Citizens Advisory Committee shall be repreSentatiVe of various community interests to include individuals from the following groups: The business/development community; the agricultural community, environmental groups; civic groups and the community at large. SECTION THP~:E: Appointments, Terms Of Office, Failure To Attend Meetings. Appointments to the Citizens Advisory Committee shall be made by the BCC based upon recommendation fr0m.''%~ ~'C~PC and staff. The formation of the Citizens Advisory Committee will be publicized and prospective members sought through newspaper advertisement. The Growth Management Coordinator shall submit to the CCPC nmues of those persons who ha~e stated an interest in serving on the Committee and others who would fulfill the requirements for composition of the Citizens Advisory Committee. The CCPC shall present a list of those interested persons and their recommendation of proposed members to serve on the Committee to the BCC for approval. In addition to the members recommended by the CCPC, the BCC shall also appoint one (1) representative from each of the 5 Commission Districts$ The terms of office for members of the Citizens Advisory Committee shall be from date of formation of the Citizens Advisory Committee and will expire on January 1, 1989 or as may be extended by the CCPC. If any member of the Citizens Advisory Committee is absent from two (2) or more meetings without a satisfactory excuse, that member's position shall be declared vacant. In such case, or in the event a vacancy occurs for any reason, such vacancy shall be fulfilled by the BCC in accordance with the procedure set forth above. SECTION FOUR: Officers; Quorum; Compensation. The officers of the Citizens Advisory Committee shall be elected by the membership of the Citizens Advisory Committee and shall include a Chairman, Vice-Chairman and Secretary a second Vice-Chairman. Committee shall, by majority vote of the entixe membership, adopt rules of procedure for the transaction of business and shall keep a record of meetings, findings and determinations. The me~bers of the Citizens Advisory Committee shall serve without compen- sation, but may be reimbursed for such travel, mileage and/or diem expenses as may be authorized by the BCC. SECTION FIVE: Location Of Meetings. All meetings of the Citizens Advisory Committee shall be public meetings. Meetings shall be held regularly at .theCollier '>':6 ~ ' County Government Center, Naples, Florida, ~nless another location is deemed aDDropriate by the Chairman of the Citizens Advisory Committee or his desiqnee~ and public notice is provided as to the location and time of the meeting. SECTION SIX: F~nctions, Powers And Duties Of The Citizens Advisory Committee. The functions, powers and duties of the Citizens Advisory Committee shall be to provide public participation an4 community input in the development and preparation of the Comprehensive Plan, or elements or portions thereof. The Committee shall assist staff in the identification of issues and problems and provide assistance in policy formulation on elements or portions of the Comprehensive Plan. The Growth Management Coordinator or her designee shall act .as staff liaison to the Committee. The Citizens Advisory Committee shall act as an advisory board to the CCPC and shall review draft work elements and make recommendations during the preparation of the Comprehensive Plan as necessary. The Citizens Advisory Committee may organize and create subcommittees for elements or portions of the Comprehensive Plan as deemed necessary. The CCPC shall ehe-¢~eae{~-~f-~y-~R~m~i~e~-, be notified of the purpose and membership of each subcommittee. SECTION SEVEN: Conflict And Severability. In the event this Ordinance conflicts with any other ordinance of Collier County or other applicable law, the more restrictive shall apply. If any phrase or portion of this Ordinance is held invalid or unconstitutional by any court of c6mpetent jurisdiction, such portion shall be deemed a separate, 3 ~ords'Underlined are added; ~ords G~eA-~A~e~A are deleted. distinct and independent provision and such holding shall not affect the validity of the remaining portion. SECTION EIGHT: Declaration of Emergency and Effective Date. This Board does hereby declare that an emergency exists and that immediate enactment of this Ordinance is necessary, and by no less than four-fifths (4/Sths) vote of the membership of the Board does hereby waive notice of intent to consider this Ordinance. A certified copy of this Ordinance, as enac~edt..sha11 be filed by the Clerk of the Board with the Department of State of . the State of Florida, as soon after enactment as is practicable by depositing the same with the postal authorities of the government of the United States for special delivery by certified mail, postage prepaid, to the Florida Department of State.
