The residential development of Im~okalee R.R.H., Ltd., will be consistent with the growth policies, land development regulations and applicable Comprehensive Plan documents for the following reasons: 1. SHORT TITLE This ordinance shall be known and cited as the Cypress Green Apartments (Immokalee R.R.H., LTD.), P.U.D. Ordinance. 3'37 SECTION Property Ownership and General Description 1.01 Introduction and Pur~osq It is the intent of Landcom, Inc. to establish and develop a Planned Unit Development (P.U.D.) on 5+ acres of property located on North 18th Street in Collier County, Florida. The site is actually between North 18th Street and North 19th Street, one block South of Lake Trafford Road. It is the purpose of this document to provide the required standards and set forth guidelines for the development of the property. 1.02 Name The P.U.D. development shall be known as Cypress Green Apartments, (I~okalee R.R.H., LTD.) 1.03 Legal Descriptioq' The South 380.72' of the Northeast 1/4 of the Northwest 1/4 of the Southeast ~L.4 of Section 32, Township 46 South, Range 29 East, Collier County, Florida, except the East 30' and the West 60' for road right of way. 1.04 Title To Property Subject property is currently under contract to be purchased by Immokalee, R.R.H., LTD, from Allen and Barbara Fish. SECTION Project Development 2.01 Purpos~ 'The purpose of this Section is to generally describe the plan of the development and to describe the general conditions that will apply to the project. 2.02 General Plan of Development Cypress Green Apartments is to be developed as a rental apartment complex to be owned, operated and maintained by the developer including all recreation facilities, retention areas, drainage swales and other common open spaces. In addition, the developer commits to affordable housing as defined by the Comprehensive Plan. 2.03 Complianc~ With A~plicable Ordinances' The project is intended to be in compliance with the applicable Collier County general zoning and subdivJ, sion regulatigns, as well as other Collier County development codes in effect .at the time permit plans are required. 2.04 Final Site Development Plans A final site plan shall be submitted for review and approval prior to issuance of,~onstruction permits. 2.05 Pro~ect Density The total acreage of the Cypress Green Apartments property is 5+ acres with a maximum density of 8.4. units per acre with a maximum of 42 rental housing units and one office/manager's unit permitted. Notel This density only applies to rental housing units. 339 3.02 3.03 3.04 SECTION III Multi-Family Residential P.U.D. 3.01 Purpose The purpose of this section is to set forth the regulations for the development of the Cypress Green Apartments in accordance with the Multi-Family Entry Level Rental Housing section of the Zoning Ordinance. Maximum Dwellin~ Units A maximum number of 42 units will be constructed on the site in accordance with the County zoning map and zoning regulations. Permitted Uses and Structures Multi-Family rental dwelling units. Permitted Accessory Uses Accessory uses and structures which are incidental to and customarily associated with the permitted uses~ A. Manager's unit/office. B. Laundry facilities. C. Any other accessory uses and structures which are incidental to and customarily associated with the permitted uses. 3.05 Property Development Re~ulations A. Mtnimu~'~ard requirements 1. Front yard 30 feet 2. Side yard 25 feet 3. Rear yard 30 feet B. Maximum height of structure - three (3) living floors. C. Minimum floor area 1. One bedroom apartment Minimum square footage - 450 Maximum square footage - 650 2. Two bedroom apartment Minimum square footage - 650 Maximum square footage - 900 3.06 Signs As may be permitted or required by the applicable Collier County Zoning Ordinance in effect at the time a permit is requested. 3.07 Off-Stre~t Parking and Drives Parking shall be provided at a rate of 1.5 spaces per one-bedroom unit and 2 spaces per two-bedroom unit. 3.08 Distance Between Structures The minimum distance between principal structures shall be one half (I/2) the sum of the height of the two principal structures, with a minimum of 15 feet. 025 P,::, 340 3.09 3.10 3.11 SECTION III (Continued) Multi-Family Residential P.U.D. Landscapin~ Minimum landscaping requirements shall be as permitted or required by the Zoning Ordinance in effect at the time a permit is requested. Bufferin~ A landscaped buffer shall be provided along all boundary lines in accordance with Section 8.37 of the Zoning Ordinance, 82-2 (or whatever Ordinance is in effect at the time building permits are requested). Other Standards Standards not specified herein are to be in accor'dance with the Collier County Zoning Ordinance in effect at the 'time permits are requested. SECTION IV General Development Commitments 4.01 Purpose The purpose of this section development of the project. is to set forth the standards for 4.01Develo~rment Commitments A. P.U.D. D~tailed site drainage plans shall be submitted to the County Engineer for review. No construction permits shall be issued unless and until approval of the proposed construction in accordance with the submitted plans is granted by the County Engineer. Zo In accordance with the Rules of the South Florida Water Management District, (SFWMD) Chapters 40E-4 and 40E-40, the entire property shall be designed for a storm event of 3-day duration and 25 year return frequency unless the entire project complies with SFWMD Chapter 40E-4.053 Conditions for Exemption. Environmental Requirements 1. A site clearing plan shall be submitted to the Natural Resources Management Department and the Community Development Division for their review and approval prior to any substantial work on the site. This plan may be submitted in phases to coincide with the development schedule. The site clearing plan shall clearly depict how the final site layout incorporates retained native vegetation to the maximum extent possible and how roads, buildings, lakes, parking lots and other facilities have been oriented to accommodage this goal. SECTION IV (Continued) General Development Commitments 2. Native species shall be utilized, where available, to the maximum extent possible in the site landscaping design. A landscaping plan will be submitted to the Natural Resources Management Department and the Community Development Division for their review and approval. This plan will depict the incorporation of native species and their mix with other species, if any. The goal of site landscaping shall be the re-creation of native vegetation and habitat characteristics lost on the site during construction or due to past activities. 3. All exotic plants, as defined in the C6unty Code, shall be removed during each phase of construction {rom development areas, open space areas, and preserve areas. Following site development a maintenance program shall be implemented to prevent reinvasion of the site by such exotic species. This plan, which will describe control techniques and inspection intervals, shall be filed with and approved by the Natural Resources Management Department and the Community Development Division. If during the course of site clearing, excavation, or other constructional activities, an archaeological or historical site, artifact or other indicator is discovered, all development at that location shall be immediately stopped and the Natural Resources Management-Department notified. Development will be suspended for a sufficient length of time to enable the Natural Resources Management Department or a designated consultant to assess the find and determine the proper course of action in regard to its salvageability. The Natural Resources Management Ddpartment will respond to any such notification in a timely and efficient manner so as to provide only a minimal interruption to any constructional activities. The petitioner should make minor adjustments in the locations of proposed structures to minimize the removal of slash pines from the parcel. Petitioner will be subject to Ordinance 75-21 (or the tree/vegetation removal ordinance in existence at the time of permitting) requiring the acquisition of a tree removal permit prior to any land clearing. : I~ODK P,~q Traffic SECTION IV (Continued) General Development Commitments The developer shall provide street lighting at each project entrance. Subject to County Engineer approval, the developer shall provide a sidewalk/bike path within the right-of-way and abutting the east and west boundaries of the property. If existing right-of-way is not adequate for construction of said sidewalk/bike path, as determined by the County Engineer, the developer, his successors or assigns shall provide such right-of-way or easement as is necessary. Sidewalk/bike path will not be required until a sidewalk/bike path network is existing and provides pedestrian/bicycle transportation to useful places within the area as determined by the county Engineer. Prior to the approval of the final phase of construction (if there is only one phase of construction then prior to approval of this one phase) if the sidewalk/bike path has not been constructed the R~veloper shall provide the necessary right-of-way or easement and, at his option, construct the sidewalk/bike path, or post a bond in the amount deemed necessary by the County Engineer to insure the sidewalk/bike path will be constructed, or make payment to the county for t~e cost of sidewalk/bike path improvements at the current cost of construction as determined by the County Engineer. If the latter is chosen the County would then be responsible for construction as part of a County-wide program. Access to the site from both 18th Street and 19th Street shall be in accordance with County Ordinance 82-91. These improvements are considered "site related" as defined in Ordinance 85-55 and shall not be applied as credits toward any impact fees required by that ordinance. Prior to completion of the project all commitments in this PUD document shall be met by the developer or his designee. If certain commitments are to be met during the final phase of construction, adequate provisions shall be established to assure that all commitments are met by the developer or his designee at the time of completion of this project. SECTION V Construction Dates Put.se The purpose of this section is to set forth the anticipated starting and completion dates for the pro~ect. 5.02 Start Date The anticipated starting date will be March 20, 1987. 5.03 Completion Date The anticipated completion date will be October 31, 1987.
