SECTION 9. Perm£te and Fees:

the nesting season, the fee for i construction permit ~ithin 100 feet of
the nesting zone of i beach ~here sea turtles neet or may neet shall be
$~0.00. The Director shall inform the applicant about sea turtle creels
· ad Meting. It shall be the responsibility or the epplicant to
that all persona ~orking on the permitted con~tructiou ers
informd. All other required state and federal permits shall be obtained
prior to a Construction in Sea Turtle Nesting Area Permit being issued.
B. Turtle HandXinS Fernit: lc shall be unicef, u1 to possess
· sea turtle without first obtaining a pertit frog the Director. There
shall be no fee for a Turtle Handling Ferule. The Dlr,ctor shall lieu,

S£CTIO~ 11. Conflict and Severance.
(a) In the reset this Ordinance conflicts with other applicable
law, the ~ora restrictive shall apply. If ny portion of thb Ordinance
is in conflict with an Ordinance of any umnicipslity vithln Collier
County, it shell not be effective eithin the mmicipality to the extent
of such conflict.
(b) If say section, subsection, sentence, clause, phrase or
portion of this Ordinance is, for any reason, held invalid or
unconstitutional by any court of cosq, etenC Jurisdiction, such portion
shell be deesmd a separate, distinct and independent provision of ouch
boldinf and shell not affect the validity of the ronainlnf portion
thereof.
