WHEREAS, the Board of Zonina Appeals has held a public hearina .. ra-'
quirad by law; ha. reviewed Patition' FDPO-85-V-3'~ accordanc.~th'S.c(~~ill
18 (5), (6) and (7), and ha. IIlade a finding that the granting of thi. p,tition
complies with the intent and purpose of Ord. 79-6~ a. follow.:
(5) The 3.'5' reducUon ~ the Flood Insurance Rate Hap (FIRM) 12.U'
National Geodetic Vert1cal Datum (NGVD) requirement to 8.5' NGVD i.

the minimum variance necellary, considering the flood hazard, to
afford reliet.
(6) The variance is ia.ued upon:
(a) A showing of good and sutticient cause bued' on review of
considerations contained in (7), following.
(b) A determination that failure to grant the variance would result
1n exceptional hardsh1p to the applicant.
(c) A determination that the granting uf a variance will not result
in increased flood heights, additional threats to public
safety, extraordinary public expense, create nuisances, ..cau.a
fraud on or victimization of the public, or conflict with
eXisting local laws or ordinances.
(7) In passing upon this variance, the Board of Zoning Appeals has
considered all technical, evaluations prOVided to it, all relevant
factors, the .tandards specified in Ordinance No. 79-62, especially
tho.e contained in Paragraph IS (7)(a-l).
NOW, THEREFORE, BE IT RESOLVED by the Board of Zoning Appeals. that
Petition FDPo-S5-V-3 i. hereby granted subject to the following condition.:

1. The variance .hall be for the reduction of the Hinimu. Ba.e Flood Ele-
vation required by Ord. No. 79-62 ~ 12.0' feet NGVD ~ H.5 feet NGVD.
2. The Chief Administrative Official shall mail a copy of this Resolution to
the petitioner by registered return receipt and such lIlailing shall
constitute compliance with Section 18, Paragraph (10) of Ord No. 79-62
which reada as follovs:
