RELATING TO PETITION NO. PU-85-13C FOR
PROVISIONAL USE OF PROPERTY HEREINAFTER r
DESCRIBED IN COLLIER COUNTY, FLORIDA.
WHEREAS, the Legislature of the State of Florida in Chapters 67-1246
•
and 125, Florida Statutes, has conferred on all counties in Florida the

, power to establish, coordinate and enforce zoning and such business
regulations as are necessary for the protection of the public; and
WHEREAS, The County pursuant thereto has adopted a Comprehensive
Zoning Ordinance establishing regulations for the zoning of particular
geographic divisions of the County, among which is the granting of
{ provisional uses; and
F . WHEREAS, the Coastal Area Planning Commission, being the duly

' appointed and constituted planning hoard for the Area hereby effected,

�A has held a public hearing after notice as in said regulations made and j
' provided, and has considered the advisability of Provisional Use (b)5 of ,
Sectiop 7.10 b. (3)(b)(5) in a "E" Estates zone for the property

hereinafter described, and has found as a matter of fact that satis-

factory provision and arrangement has been made concerning all applicable

Collier County, Florida that the petition of PU-85-13C with respect to the
property hereinafter described nn;

I, Thomas Peek, as owner or authorized agent for Petition
'' PU-85-13C, agree to the following stipulations requested by the Coastal
Area Planning Commission in their public hearing on August 15, 1985. t.
a. The four stipulations by the Environmental Advisory Council, per
staff report dated August 9, 1985
b. Detailed site drainage plans for the entire contiguous property
shall be submitted to the County Engineer for review for all new
construction. No construction permits shall be issued unless and
until approval of the proposed construction in accordance with the
( submitted plans is granted by the County Engineer.
c. There shall be no additional points of access along Golden Gate
Parkway. All traffic must enter and exit via the existing
driveways.
d. The Utilities Division must receive a le er from the Utility which
will erve this pr erty, confirming the a lability of,sewage
collet n and trcatm t capacity to serve the erenced property. b°
This lett must contain binding statement that quote treatment
capacity is vailable and ib eserved for the propose tructure,
