CONCLUSIONS OF LAW AND ORDER OF THE BOARD THIS CAUSE came on for public hearing before the Board on July 22, 2010, and the Board, having heard testimony under oath, received evidence, and heard respective to all appropriate matters, thereupon issues its Findings of Fact, Conclusions of Law, and Order of the Board, as follows: 1. That Palm Lake, LLC are the owners of the subject property. 2. That the Code Enforcement Board has jurisdiction of the person of the Respondents and that the Respondents, having been duly notified, appeared at the public hearing by Louis Erickson, Esq. 3. That the Respondents were notified of the date of hearing by certified mail and by posting. 4. That the real property located at 3 I 31 Tamiami Trail E., Naples, Florida 34112, Folio 61842240009, more particularly described as (see attached legal) is in violation of Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54-181 and Section 54-179 in the following particulara: Litter consisting of, but not limited to, wood, metal, buckets, glass, furniture, plastic, and other debris scattered throughout the property. ORDER OF THE BOARD Based upon the foregoing Findings of Fact and Conclusions of Law and to the authority granted in Chapter 162, Florida Statutes, and Collier County Ordinance No. 04-41, it is hereby ORDERED: That the violations of Collier County Code of Laws and Ordinances, Chapter 54, Article VI, Section 54- 181 and Section 54-179 be corrected in the following manner: 1. By removing and property dispose of litter/abandoned items, consisting of, but not limited to: wood, metal, buckets, glass, furniture, plastic bags and bottles and other debris scattered throughout the property within 60 days (September 20, 2010). 2. That if the Respondents do not comply with paragraph I of the Order of the Board by September 20, 2010, then there will be a fine of $200.00 per day for each day until the violation is abated. OR 4591 PG 1637 3. That the Respondents are to notify Code Enforcement officials that the violation has been abated within 24 hours of abatement and request the Investigator to come out and perform a final inspection to confinn the abatement. 4. That if the Respondents fail to abate the violation, the county may abate the violation and may use the assistance afthe Collier County Sheriff's Office to enforce the provisions of this order and all costs ofahatement shall be assessed to the property owner. S. That the Respondents are ordered to pay all operational costs incurred in the prosecution of this Case in the amount of$80.86 within 30 days. Any aggrieved party may appeal a final order of the Board to the Circuit Court within thirty (30) days of the execution of the Order appealed. An appeal shall not be a hearing de novo, but shall be limited to appellate review of the record created within. Filing an Appeal shall not stay the Board's Order. ORDER OF THE BOARD Based upon the foregoing Findings of Fact and Conclusions of Law and to the authority granted in Chapter 162, Florida Statutes, and Collier County Ordinance No. 04-41, it is hereby ORDERED: Thatthe violations of Ordinance 04-41, the Collier County Land Development Code, as amended, section 2.01.00(A) be corrected in the following manner: 1. That if the Respondents do not comply with paragraph 1 of the Order of the Board by September 20, 2010, then there will be a fine of $200.00 per day for each day until the violation is abated. Electrical mete'rs are not securely fastened; missing covers on energized electrical parts, direct wires and conduit are not buried to code. ORDER OF THE BOARD Based upon the foregoing Findings of Fact and Conclusions of Law and to the authority granted in Chapter 162, Florida Statutes, and Collier County Ordinance No. 04-4], it is hereby ORDERED: That the violations of Collier County Code of Laws and Ordinances, Chapter 22. Article VI, Section 22. 231 (11) be corrected in the following manner: 1. By hiring a licensed electrician to abate the four areas of imminent danger, specifically detailed on the Site plan (two areas between lots 48 and 24 need metal covers; one exposed wire on southside at park entrance along fence line should be discoIUlected from the power source; and one exposed wire on ground at entrance of Park should be disconnected from the power source) within 7 days (July 29, 2010) OR 4591 PG 1647 2, By applying for and obtaining all valid Collier County Building permits, inspections, certificate of completions, and correcting all electrical violations by bringing them into compliance with the current National Electrical Code within 60 days (September 20, 2010). 3. That if the Respondents do not comply with paragraph 1 of the Order ofthe Board by July 29, 2010, then there will he a fine of $500.00 per day for each day until the violation is abated. 4. That if the Respondents do not comply with paragraph 2 of the Order of the Board by September 20, 2010, then there will be a fine of$200.00 per day for each day until the violation is abated. 5. That the Respondents are to notify Code Enforcement officials that the violation has been abated within 24 hours of abatement and request the Investigator to come out and perform a final inspection to confirm the abatement. 5. CONCLUSIONS OF LAW AND ORDER OF THE BOARD THIS CAUSE came on for public hearing before the Board on July 22, 2010, and the Board, having heard testimony under oath, received evidence, and heard respective to all appropriate matters, thereupon issues its Findings ofFaet, Conclusions of Law, and Order of the Board, as follows: 1. That Leonel Garza, et. a1. are the owners of the subject property. 2. That the Code Enforcement Board has jurisdiction of the person of the Respondents and that the Respondents, having been duly notified, appeared at the public hearing and entered into a Stipulation. 3. That the Respondents were notified ofthe date of hearing by certified mail and by posting. 4. That the real property located at III 7" Street, Immokalee, FL 34142, Folio 25582720003, more particularly described as Lot 9, Block 6, of Carson's Subdivision, as recorded in Plat Book 4, Page 40, Public Records ofeallier County, Florida, is in violation of the Collier County Code of Laws and Ordinances, Chapter 22, Building and Building Regulations, Article VI, and the Property Maintenance Code, Sections 22-231 (I2)(b), (I), (g), (i), and (j) in the following particulars: Exterior walls on a residential structure that had holes, breaks, loose rotting material that was not weather tight and not maintained in good repair. Also observed no guard rails on the approaching footsteps, the stairs consist of unstable blocks, windows and doors were not weather and watertight, nor were they maintained in good repair. The screens on the windows were missing or they had been removed. The exterior surface of the whole structure was in poor condition. ORDER OF THE BOARD Based upon the foregoing Findings of Faet and Conclusions of Law, to the Stipulation, attached hereto and incorporated herein, and to the authority granted in Chapter 162, Florida Statutes, and Collier County Ordinance No. 04-41, it is hereby ORDERED: That the violations of the Collier County Code of Laws and Ordinances, Chapter 22, Building and Building Regulations, Article VI, and the Property Maintenance Code, Sections 22-231 (12)(b), (I), (g), (i), and (j) be corrected in the following manner: OR 4591 PG 1660 1. By applying for and obtaining a valid Collier County Building permit and bringing property into compliance or obtaining a Demolition Permit and removing all unpermitted improvements and materials, and requesting all required inspections through certificate of completion (CO) within 120 days (November 19, 2010). 2. That if the Respondents do not comply with paragraph 1 of the Order of the Board by November 19, 2010, then there will be a fine of $200.00 per day for each day until the violation is abated. 3. That the Respondents are to notify Code Enforcement officials that the violation has been abated within 24 hours of abatement and request the Investigator to come out and perfonn a final inspection to confirm the abatement. 4. That if the Respondents fail to abate the violation, the county may abate the violation and may use the assistance of the Collier County Sherifrs Office to enforce the provisions of this order and all costs of abatement shall be assessed to the property owner. 5. That the Respondents are ordered to pay all operational costs incurred in the prosecution of this Case in the amount of$84.01 within 30 days. Any aggrieved party may appeal a final order of the Board to the Circuit Court within thirty (30) days of the execution of the Order appealed.
